1 1 Amend the amendment, H-3109, to House File 2 as
1 2 follows:
1 3 #1. Page 7, by inserting after line 42 the
1 4 following:
1 5 " . After a verdict has been rendered it shall
1 6 be recorded on the jury verdict form and shall be read
1 7 and recorded in open court. The jurors shall be
1 8 collectively asked by the court whether the verdict
1 9 returned is their true and correct verdict. Even
1 10 though no juror makes any declaration to the contrary,
1 11 the jury shall, if either party so requests, be polled
1 12 and each juror shall be separately asked whether the
1 13 verdict rendered by the jury foreperson is the juror's
1 14 true and correct verdict. If, upon either the
1 15 collective or the separate inquiry, any juror denies
1 16 that the verdict is the juror's verdict, the court
1 17 shall refuse to accept the verdict. The court may
1 18 direct inquiry or permit inquiry by counsel to
1 19 ascertain whether any juror has been subjected to
1 20 coercion or has become confused during the jury
1 21 deliberation process. The court may, as appropriate,
1 22 direct the jury to resume deliberation in the case.
1 23 If no disagreement on the verdict is expressed by any
1 24 of the jurors, the court shall discharge the jury."
1 25 #2. Page 13, by inserting after line 32 the
1 26 following:
