1 1 Amend the amendment, H-3109, to House File 2 as
1 2 follows:
1 3 #1. Page 16, by striking lines 1 through 3 and
1 4 inserting the following:
1 5 "Sec. . EFFECTIVE DATE &endash; SEVERABILITY &endash;
1 6 SENTENCES COMMUTED TO LIFE IMPRISONMENT IF ACT
1 7 UNCONSTITUTIONAL.
1 8 1. This Act takes effect October 1, 1995, and
1 9 applies to offenses committed on or after that date.
1 10 2. If any provision of this Act or the application
1 11 thereof to any person is invalid, the invalidity shall
1 12 not affect the provisions or application of this Act
1 13 which can be given effect without the invalid
1 14 provisions or application and to this end the
1 15 provisions of this Act are severable.
1 16 3. If the imposition of a sentence of death under
1 17 this Act is found to be unconstitutional, the sentence
1 18 of any person who has been sentenced to death under
1 19 this Act shall automatically be commuted to a term of
1 20 life imprisonment."
1 21 #2. Page 16, by inserting after line 10 the
1 22 following:
1 23 "# . Title page, line 6, by inserting after the
1 24 word "providing" the following: "an effective date
1 25 and".
1 26 #3. By numbering, renumbering, and correcting
1 27 internal references, as necessary.
