1 1 Amend the amendment, H-3109, to House File 2 as

1 3 #1. Page 7, by inserting after line 14 the
1 4 following:
1 5 " . After submission of the issues, but prior to
1 6 the commencement of the jury deliberations in the
1 7 penalty proceeding, the court shall instruct the jury
1 8 that if the defendant is not sentenced to death, the
1 9 court is required by law to impose a sentence of
1 10 imprisonment until death without parole. The court
1 11 shall further instruct the jury that the sentence of
1 12 imprisonment until death without parole is required by
1 13 law if the jury fails to reach a unanimous verdict
1 14 recommending a sentence of death."

1 16 internal references as necessary.
