  1  1    Amend House File 126 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  Section 523H.2, Code 1995, is amended
  1  5 to read as follows:
  1  6    523H.2  APPLICABILITY.
  1  7    This chapter applies to a new or existing franchise
  1  8 that is operated in the state of Iowa created and
  1  9 operated in this state on or after July 1, 1995.  For
  1 10 purposes of this chapter, the franchise is operated in
  1 11 this state only if the premises from which the
  1 12 franchise is operated is physically located in this
  1 13 state.  For purposes of this chapter, a franchise
  1 14 including marketing rights in or to this state, is
  1 15 deemed to be operated in this state only if the
  1 16 franchisee's principal business office is physically
  1 17 located in this state.  This chapter does not apply to
  1 18 a franchise solely because an agreement relating to
  1 19 the franchise provides that the agreement is subject
  1 20 to or governed by the laws of this state.  The
  1 21 provisions of this chapter do not apply to any
  1 22 existing or future contracts between Iowa franchisors
  1 23 or non-Iowa franchisors and out-of-state franchisees
  1 24 operating franchises physically located outside of
  1 25 this state."
