SUBCOMMITTEE BUSINESS

1. Procedural Business.
Call to Order. Co-chairperson Representative Jeff Lamberti called the meeting to order at 1:40 p.m., January 5th, 1999, in Room 118 of the State Capitol.
Adjournment. The meeting adjourned at 4:35 p.m.
Next Meeting Date. No specific date was set for the next meeting. The Subcommittee did, however, agree that it would meet again to consider reclassifying certain aggravated misdemeanor or felony offenses.
Nomination of Subcommittee Chairperson. The Subcommittee nominated the Honorable J. G. Johnson as the chairperson.
2. Subcommittee Discussion and Recommendation.
Commission members discussed the reclassification of and the change in the threshold limit of certain misdemeanor offenses. The following misdemeanor offenses were recommended to the full Sentencing Commission to be reclassified or changed:
  1. Interference with official acts (serious misdemeanor violation).
  2. Driving while license under suspension (Iowa Code 321.218 and 321A.32).
  3. Driving while barred.
  4. Possession of alcohol under legal age (2nd offense).
  5. Fireworks in state parks.
  6. Theft in the 4th degree and 5th degree.
  7. Fraudulent practice in the 4th degree and 5th degree.
  8. Criminal mischief in the 4th degree and 5th degree.
  9. Computer damage in the 4th degree and 5th degree.
  10. Computer theft in the 4th degree and 5th degree.
  11. Polygraph examination by employers.
  12. Interference with signs or signals.
This list was submitted to the full Sentencing Commission which met the next day on January 6, 1999. See the Sentencing Commission minutes of January 6, 1999, for the Commission's action on this recommendation.
