The administrator shall immediately investigate the legal settlement of the person and proceed as follows:
1. If the administrator finds that the decision of the board of supervisors or the court as to legal settlement of the person is correct, the administrator shall cause the person either to be transferred to a resource center or a special unit and there maintained at the expense of the state or to be transferred to the place of foreign settlement.
2. If the administrator finds that the decision of the board of supervisors or the court is not correct, the administrator shall order the person transferred to a state resource center or a special unit and there maintained at the expense of the county of legal settlement in this state.
