1 1 Section 1. Section 455B.133, Code 2003, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 11. Adopt rules consistent with those
1 4 adopted by the United States environmental protection agency
1 5 pursuant to the federal Clean Air Act as amended through
1 6 January 1, 2004. Such rules shall be no more stringent,
1 7 restrictive, or inclusive than those of the United States
1 8 environmental protection agency.
1 9 Sec. 2. Section 455B.173, Code 2003, is amended by adding
1 10 the following new subsection:
1 11 NEW SUBSECTION. 14. Adopt rules consistent with those
1 12 adopted by the United States environmental protection agency
1 13 pursuant to the federal Clean Water Act as amended through
1 14 January 1, 2004. Such rules shall be no more stringent,
1 15 restrictive, or inclusive than those of the United States
1 16 environmental protection agency.
1 17 EXPLANATION
1 18 This bill relates to air and water regulations adopted by
1 19 the environmental protection commission.
1 20 The bill provides that the environmental protection
1 21 commission shall adopt rules consistent with those adopted by
1 22 the United States environmental protection agency pursuant to
1 23 the federal Clean Air Act and the federal Clean Water Act as
1 24 amended through January 1, 2004. The bill provides that such
1 25 rules shall be no more stringent, restrictive, or inclusive
1 26 than those of the United States environmental protection
1 27 agency.
