PAG LIN 1 1 Section 1. Section 99D.25, subsection 5, Code 2003, is 1 2 amended to read as follows: 1 3 5. Every horse which suffers a breakdown on the racetrack, 1 4 in training, or in competition, and is destroyed, and every 1 5 other horse which expires while stabled on the racetrack under 1 6 the jurisdiction of the commission, shall undergo a postmortem 1 7 examination by a veterinarian or a veterinary pathologist at a 1 8 time and place acceptable to the commission veterinarian to 1 9 determine the injury or sickness which resulted in euthanasia 1 10 or natural death.The postmortem examination shall be1 11conducted by a veterinarian employed by the owner or the1 12owner's trainer in the presence of and in consultation with1 13the commission veterinarian.Test samples shall be obtained 1 14 from the carcass upon which the postmortem examination is 1 15 conducted and shall be sent to a laboratory approved by the 1 16 commission for testing for foreign substances and natural 1 17 substances at abnormal levels. When practical, blood and 1 18 urine test samples should be procured prior to euthanasia. 1 19 The owner of the deceased horse is responsible for payment of 1 20 any charges duethe veterinarian employedto conduct the 1 21 postmortem examination.The services of the commission1 22veterinarian and the laboratory testing of postmortem samples1 23shall be made available by the commission without charge to1 24the owner.A record of every postmortem shall be filed with 1 25 the commission by theowner'sveterinarian or veterinary 1 26 pathologist who performed the postmortem within seventy-two 1 27 hours of the deathand shall be submitted on a form supplied1 28by the commission. Each owner and trainer accepts the 1 29 responsibility for the postmortem examination provided herein 1 30 as a requisite for maintaining the occupational license issued 1 31 by the commission. 1 32 Sec. 2. EFFECTIVE DATE RETROACTIVE APPLICABILITY. This 1 33 Act takes effect April 1, 2004. If the bill is enacted after 1 34 April 1, 2004, this Act, being deemed of immediate importance, 1 35 takes effect upon enactment and is retroactively applicable to 2 1 April 1, 2004, and is applicable on and after that date. 2 2 EXPLANATION 2 3 This bill relates to the conducting of a postmortem 2 4 examination of a horse that dies at a racetrack. The bill 2 5 provides that the postmortem be conducted by a veterinarian or 2 6 veterinary pathologist. Currently, the owner's or trainer's 2 7 veterinarian is required to conduct the postmortem in the 2 8 presence of the racing and gaming commission's veterinarian. 2 9 The bill further provides that the owner of the horse is 2 10 required to pay the costs associated with the postmortem and 2 11 any laboratory testing. Currently, the owner is not 2 12 responsible for paying the costs for the services of the 2 13 commission veterinarian and the laboratory testing of 2 14 postmortem samples. 2 15 The bill takes effect April 1, 2004.
