  1  1    Section 1.  NEW SECTION.  331.605C  ELECTRONIC TRANSACTIONS
  1  2 FEE – AUDIT.
  1  3    1.  The recorder shall also collect a fee of five dollars
  1  4 for each recorded transaction for which a fee is paid pursuant
  1  5 to section 331.604 to be used for the purposes of planning and
  1  6 implementing electronic recording and electronic transactions
  1  7 in each county and developing county and statewide websites to
  1  8 provide electronic access to records and information.  The
  1  9 treasurer, on behalf of the recorder, shall establish and
  1 10 maintain an interest-bearing account into which all moneys
  1 11 collected pursuant to this section shall be deposited.  The
  1 12 recorder shall use the moneys deposited in the account to
  1 13 carry out the purposes of this section.  The recorder may
  1 14 cooperate with other entities, boards, and agencies to
  1 15 establish methods for electronic recording and conducting of
  1 16 transactions and may participate in other joint ventures which
  1 17 further the purposes of this subsection.
  1 18    2.  The recorder shall make available any information
  1 19 required by the county or state auditor concerning the fees
  1 20 collected under this section for the purposes of determining
  1 21 the amount of fees collected and the uses for which such fees
  1 22 are expended.  
  1 23                           EXPLANATION
  1 24    This bill allows the county recorder to collect an
  1 25 electronic transactions fee of $5 for each recorded
  1 26 transaction for which a fee is already paid pursuant to the
  1 27 general recording and filing fee requirements of Code section
  1 28 331.604.  The purpose of the electronic transactions fee is to
  1 29 fund the planning and implementation of electronic recording
  1 30 and electronic transactions in each county and development of
  1 31 county and statewide websites.
  1 32    The bill provides that the county treasurer shall establish
  1 33 and maintain an interest-bearing account into which all
  1 34 electronic transactions fees collected are deposited.  The
  1 35 bill provides that the recorder may cooperate with other
  2  1 entities, boards, and agencies and participate in other joint
  2  2 ventures to carry out the purposes of planning and
  2  3 implementing electronic transactions in the county.  The bill
  2  4 also provides that the recorder shall make information
  2  5 available to the county or state auditor concerning the fees
  2  6 collected pursuant to the bill and the uses for which the fees
  2  7 are expended.
