PAG LIN 1 1 Section 1. NEW SECTION. 103A.7A STATE PLUMBING CODE. 1 2 The state building code commissioner shall establish, 1 3 publish, and enforce a code of rules governing the 1 4 installation of plumbing in cities and amend the same when 1 5 deemed necessary. 1 6 Sec. 2. Section 135.11, subsection 5, Code Supplement 1 7 2003, is amended by striking the subsection. 1 8 Sec. 3. Section 231B.2, subsection 2, paragraph d, Code 1 9 Supplement 2003, is amended to read as follows: 1 10 d. An elder group home shall be located in an area zoned 1 11 for single-family or multiple-family housing or in an 1 12 unincorporated area and shall be constructed in compliance 1 13 with applicable local housing codes and the rules adopted for 1 14 the special classification by the state fire marshal. In the 1 15 absence of local building codes, the facility shall comply 1 16 with the state plumbing codeestablished pursuant to section1 17135.11and the state building code, both established pursuant 1 18 to chapter 103A. 1 19 Sec. 4. Section 473.44, subsection 1, Code 2003, is 1 20 amended to read as follows: 1 21 1. The department shall adopt rules which prescribe water 1 22 use standards for each product classified as a covered product 1 23 under this section. The standards adopted shall be designed 1 24 to achieve the maximum efficiency of water use which the 1 25 department determines is technologically and economically 1 26 feasible. The department shall consult with the state 1 27 building code commissioner, the Iowa department of public1 28health,and the plumbing manufacturers' institute, and shall 1 29 review all applicable provisions under chapter 103Aand1 30chapter 135in establishing the standards. 1 31 Sec. 5. ADMINISTRATIVE RULES TRANSITION PROVISIONS. 1 32 The state plumbing code as adopted by the Iowa department of 1 33 public health and in effect on the effective date of this Act 1 34 shall continue in full force and effect until amended, 1 35 repealed, or supplemented by affirmative action of the state 2 1 building code commissioner under the authority established by 2 2 this Act. In regard to updating references and format in the 2 3 Iowa administrative code in order to correspond to the 2 4 transfer of authority concerning the state plumbing code as 2 5 established in this Act, the administrative rules coordinator 2 6 and the administrative rules review committee, in consultation 2 7 with the administrative code editor, shall jointly develop a 2 8 schedule for the necessary updating of the Iowa administrative 2 9 code. 2 10 Sec. 6. EFFECTIVE DATE. This Act, being deemed of 2 11 immediate importance, takes effect upon enactment. 2 12 EXPLANATION 2 13 This bill transfers the authority for establishing the 2 14 state plumbing code from the Iowa department of public health 2 15 to the state building code commissioner. The bill provides 2 16 that the current state plumbing code remains in effect until 2 17 the state building code commissioner amends, repeals, or 2 18 supplements the plumbing code. The bill also provides for the 2 19 updating of the Iowa administrative code based upon the 2 20 transfer of authority. 2 21 The bill takes effect upon enactment. 2 22 LSB 6777SV 80 2 23 ec/gg/14
