  1  4 RELATING TO MENINGOCOCCAL DISEASE VACCINATION INFORMATION
  1  5    FOR STUDENTS WHO ARE ENROLLED IN AN INSTITUTION OF HIGHER
  1  6    LEARNING THAT HAS AN ON-CAMPUS DORMITORY OR RESIDENCE HALL,
  1  7    AND PROVIDING FOR RELATED MATTERS.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  NEW SECTION.  139A.26  MENINGOCOCCAL DISEASE
  1 12 VACCINATION INFORMATION FOR POSTSECONDARY STUDENTS.
  1 13    1.  Each institution of higher education that has an on-
  1 14 campus residence hall or dormitory shall provide vaccination
  1 15 information on meningococcal disease to each student enrolled
  1 16 in the institution.  The vaccination information shall be
  1 17 contained on student health forms provided to each student by
  1 18 the institution, which forms shall include space for the
  1 19 student to indicate whether or not the student has received
  1 20 the vaccination against meningococcal disease.  The
  1 21 vaccination information about meningococcal disease shall
  1 22 include any recommendations issued by the national centers for
  1 23 disease control and prevention regarding the disease.
  1 24 Vaccination information obtained under this section that is in
  1 25 possession of an institution of higher education pursuant to
  1 26 this section shall not be considered a public record.  Data
  1 27 obtained under this section shall be submitted annually to the
  1 28 department in a manner prescribed by the department and such
  1 29 that no individual person can be identified.
  1 30    2.  This section shall not be construed to require any
  1 31 institution of higher education to provide the vaccination
  1 32 against meningococcal disease to students.
  1 33    3.  This section shall not apply if the national centers
  1 34 for disease control and prevention no longer recommend the
  1 35 meningococcal disease vaccine.
  2  1    4.  This section does not create a private right of action.
  2  2    5.  The department shall adopt rules for administration of
  2  3 this section.  The department shall review the requirements of
  2  4 this section at least every five years, and shall submit its
  2  5 recommendations for modification to, or continuation of, this
  2  6 section based upon new information about the disease or
  2  7 vaccination against the disease in a report that shall be
  2  8 submitted to the general assembly no later than January 15,
  2  9 2010, with subsequent reports developed and submitted by
  2 10 January 15 at least every fifth year thereafter.
