1 4 RELATING TO THE FUNDING OF EFFORTS TO ALLEVIATE A PUBLIC HEALTH
1 5 EMERGENCY OR DISASTER.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 135.144, Code Supplement 2003, is
1 10 amended by adding the following new subsection:
1 11 NEW SUBSECTION. 11. If a public health disaster or other
1 12 public health emergency situation exists which poses an
1 13 imminent threat to the public health, safety, and welfare, the
1 14 department, in conjunction with the governor, may provide
1 15 financial assistance, from funds appropriated to the
1 16 department that are not otherwise encumbered, to political
1 17 subdivisions as needed to alleviate the disaster or the
1 18 emergency. If the department does not have sufficient
1 19 encumbered funds, the governor may request that the executive
1 20 council, pursuant to the authority of section 7D.29, commit
1 21 sufficient funds, up to one million dollars, that are not
1 22 otherwise encumbered from the general fund, as needed and
1 23 available, for the disaster or the emergency. If additional
1 24 financial assistance is required in excess of one million
1 25 dollars, approval by the legislative council is also required.
