1 1 Section 1. NEW SECTION. 73.31 OUTSOURCING BY STATE
1 2 AGENCIES PROHIBITED.
1 3 A state department, institution, or agency, or any board
1 4 member, commissioner, director, manager, or other person
1 5 connected with any such department, institution, or agency,
1 6 shall not award a contract to a nonresident alien as defined
1 7 in section 9H.1, or to a person for a contract or subcontract
1 8 for services to be performed outside of the boundaries of the
1 9 United States, unless the desired services cannot be obtained
1 10 in the United States. Any contract entered into by a state
1 11 department, director, manager, or other person connected with
1 12 any such department, institution, or agency shall stipulate
1 13 that the service provided under the contract shall be
1 14 performed within the boundaries of the United States, unless
1 15 the desired service cannot be obtained in the United States.
1 16 EXPLANATION
1 17 This bill prohibits state entities from awarding a contract
1 18 to a nonresident alien or to a person for a contract or
1 19 subcontract for services to be performed outside the United
1 20 States. The bill also requires that any contract entered into
1 21 by a state agency stipulate that the contracted service shall
1 22 be performed within U.S. boundaries, unless the desired
1 23 service cannot be obtained in this country.
