  1  4 RELATING TO AND MAKING APPROPRIATIONS INVOLVING STATE 
  1  5    GOVERNMENT, INCLUDING PROVISIONS AFFECTING AGRICULTURE
  1  6    AND NATURAL RESOURCES.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10                           DIVISION I
  1 11         DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
  1 12                      GENERAL APPROPRIATION
  1 13    Section 1.  GENERAL DEPARTMENT APPROPRIATION.  There is
  1 14 appropriated from the general fund of the state to the
  1 15 department of agriculture and land stewardship for the fiscal
  1 16 year beginning July 1, 2003, and ending June 30, 2004, the
  1 17 following amount, or so much thereof as is necessary, to be
  1 18 used for the purposes designated:
  1 19    a.  For purposes of supporting the department, including
  1 20 its divisions, for administration, regulations, and programs,
  1 21 for salaries, support, maintenance, miscellaneous purposes,
  1 22 and for not more than the following full-time equivalent
  1 23 positions:  
  1 24 .................................................. $ 16,365,273
  1 25 ............................................... FTEs     440.13
  1 26    b.  Of the amount appropriated in paragraph "a", the
  1 27 department shall not expend less than $50,000 for salaries,
  1 28 support, maintenance, and miscellaneous purposes related to
  1 29 the administration of the senior farmers' market nutrition
  1 30 program under the jurisdiction of the United States department
  1 31 of agriculture.  
  1 32                           DIVISION II
  1 33         DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
  1 34                     SPECIAL APPROPRIATIONS
  1 35    Sec. 2.  RIVER AUTHORITY.  There is appropriated from the
  2  1 general fund of the state to the department of agriculture and
  2  2 land stewardship for the fiscal year beginning July 1, 2003,
  2  3 and ending June 30, 2004, the following amount, or so much
  2  4 thereof as is necessary, to be used for the purposes
  2  5 designated:
  2  6    For purposes of supporting the department for membership in
  2  7 the state interagency Missouri river authority, created in
  2  8 section 28L.1, in the Missouri river basin association:  
  2  9 .................................................. $      9,780
  2 10    Sec. 3.  HORSE AND DOG RACING.  There is appropriated from
  2 11 the moneys available under section 99D.13 to the
  2 12 administrative division of the department of agriculture and
  2 13 land stewardship for the fiscal year beginning July 1, 2003,
  2 14 and ending June 30, 2004, the following amount, or so much
  2 15 thereof as is necessary, to be used for the purposes
  2 16 designated:
  2 17    For salaries, support, maintenance, and miscellaneous
  2 18 purposes for the administration of section 99D.22:  
  2 19 .................................................. $    305,516
  2 20    Sec. 4.  REGULATORY DIVISION DAIRY PRODUCTS CONTROL BUREAU.
  2 21 There is appropriated from the general fund of the state to
  2 22 the department of agriculture and land stewardship for the
  2 23 fiscal year beginning July 1, 2003, and ending June 30, 2004,
  2 24 the following amount, or so much thereof as is necessary, to
  2 25 be used for the purposes designated:
  2 26    For purposes of supporting the operations of the dairy
  2 27 products control bureau within the department's regulatory
  2 28 division, including salaries, support, maintenance, and
  2 29 miscellaneous purposes:  
  2 30 .................................................. $    648,379
  2 31                          DIVISION III
  2 32                 DEPARTMENT OF NATURAL RESOURCES
  2 33                     GENERAL APPROPRIATIONS
  2 34    Sec. 5.  GENERAL DEPARTMENT APPROPRIATION.  There is
  2 35 appropriated from the general fund of the state to the
  3  1 department of natural resources for the fiscal year beginning
  3  2 July 1, 2003, and ending June 30, 2004, the following amount,
  3  3 or so much thereof as is necessary, to be used for the
  3  4 purposes designated:
  3  5    For purposes of supporting the department, including its
  3  6 divisions, for administration, regulation, and programs, for
  3  7 salaries, support, maintenance, miscellaneous purposes, and
  3  8 for not more than the following full-time equivalent
  3  9 positions:  
  3 10 .................................................. $ 15,489,070
  3 11 ............................................... FTEs    1079.12
  3 12    Sec. 6.  STATE FISH AND GAME PROTECTION FUND –
  3 13 APPROPRIATION TO THE DIVISION OF FISH AND WILDLIFE.
  3 14    1.  a.  There is appropriated from the state fish and game
  3 15 protection fund to the department of natural resources for the
  3 16 fiscal year beginning July 1, 2003, and ending June 30, 2004,
  3 17 the following amount, or so much thereof as is necessary, to
  3 18 be used for the purposes designated:
  3 19    For use by the division of fish and wildlife for
  3 20 administrative support, and for salaries, support,
  3 21 maintenance, equipment, and miscellaneous purposes:  
  3 22 .................................................. $ 29,288,895
  3 23    b.  Notwithstanding section 455A.10, the department may use
  3 24 the unappropriated balance remaining in the fish and game
  3 25 protection fund to provide for the funding of health and life
  3 26 insurance premium payments from unused sick leave balances of
  3 27 conservation peace officers employed in a protection
  3 28 occupation who retire, pursuant to section 97B.49B.
  3 29    2.  The department shall not expend more moneys from the
  3 30 fish and game protection fund than provided in this section,
  3 31 unless the expenditure derives from contributions made by a
  3 32 private entity, or a grant or moneys received from the federal
  3 33 government, and is approved by the natural resource
  3 34 commission.  The department of natural resources shall
  3 35 promptly notify the legislative fiscal bureau and the
  4  1 chairpersons and ranking members of the joint appropriations
  4  2 subcommittee on agriculture and natural resources concerning
  4  3 the commission's approval.  
  4  4                           DIVISION IV
  4  5                 DEPARTMENT OF NATURAL RESOURCES
  4  6              RELATED TRANSFERS AND APPROPRIATIONS
  4  7    Sec. 7.  SNOWMOBILE FEES – TRANSFER FOR ENFORCEMENT
  4  8 PURPOSES.  There is transferred on July 1, 2003, from the fees
  4  9 required to be deposited in the special conservation fund
  4 10 under section 321G.7 to the fish and game protection fund and
  4 11 appropriated to the department of natural resources for the
  4 12 fiscal year beginning July 1, 2003, and ending June 30, 2004,
  4 13 the following amount, or so much thereof as is necessary, to
  4 14 be used for the purpose designated:
  4 15    For enforcing snowmobile laws as part of the state
  4 16 snowmobile program administered by the department of natural
  4 17 resources:  
  4 18 .................................................. $    100,000
  4 19    Sec. 8.  VESSEL FEES – TRANSFER FOR ENFORCEMENT PURPOSES.
  4 20 There is transferred on July 1, 2003, from the fees required
  4 21 to be deposited in the special conservation fund under section
  4 22 462A.52 to the fish and game protection fund and appropriated
  4 23 to the natural resource commission for the fiscal year
  4 24 beginning July 1, 2003, and ending June 30, 2004, the
  4 25 following amount, or so much thereof as is necessary, to be
  4 26 used for the purpose designated:
  4 27    For the administration and enforcement of navigation laws
  4 28 and water safety:  
  4 29 .................................................. $  1,400,000
  4 30    Notwithstanding section 8.33, moneys transferred and
  4 31 appropriated in this section that remain unencumbered or
  4 32 unobligated at the close of the fiscal year shall not revert
  4 33 to the credit of the fish and game protection fund but shall
  4 34 be credited to the special conservation fund established by
  4 35 section 462A.52 to be used as provided in that section.  
  5  1                           DIVISION V
  5  2                 DEPARTMENT OF NATURAL RESOURCES
  5  3                     SPECIAL APPROPRIATIONS
  5  4    Sec. 9.  REVENUE ADMINISTERED BY THE IOWA COMPREHENSIVE
  5  5 UNDERGROUND STORAGE TANK FUND BOARD.  There is appropriated
  5  6 from the unassigned revenue fund administered by the Iowa
  5  7 comprehensive underground storage tank fund board, to the
  5  8 department of natural resources for the fiscal year beginning
  5  9 July 1, 2003, and ending June 30, 2004, the following amount,
  5 10 or so much thereof as is necessary, to be used for the purpose
  5 11 designated:
  5 12    For administration expenses of the underground storage tank
  5 13 section of the department of natural resources:  
  5 14 .................................................. $    200,000
  5 15    Sec. 10.  OIL OVERCHARGE MONEYS.  There is appropriated
  5 16 from those moneys designated within the energy conservation
  5 17 trust created in section 473.11, for disbursement pursuant to
  5 18 section 473.11, to the following named agencies for the fiscal
  5 19 year beginning July 1, 2003, and ending June 30, 2004, the
  5 20 following amounts, or so much thereof as is necessary, to be
  5 21 used for the purposes designated:
  5 22    1.  To the division of community action agencies of the
  5 23 department of human rights for qualifying energy conservation
  5 24 programs for low-income persons, including but not limited to
  5 25 energy weatherization projects which target the highest energy
  5 26 users, and including administrative costs:
  5 27    To be expended from the Exxon fund:  
  5 28 .................................................. $     50,000
  5 29    2.  To the department of natural resources for the
  5 30 following purposes:
  5 31    a.  For the state energy program, from the Exxon fund:  
  5 32 .................................................. $     50,000
  5 33    b.  For administration of petroleum overcharge programs
  5 34 from the Stripper Well fund, not to exceed the following
  5 35 amount:  
  6  1 .................................................. $     25,000
  6  2    Notwithstanding section 8.33, the unencumbered or
  6  3 unobligated moneys remaining at the end of any fiscal year
  6  4 from the appropriations made in subsections 1 and 2 shall not
  6  5 revert but shall be available for expenditure during
  6  6 subsequent fiscal years until expended for the purposes for
  6  7 which originally appropriated.
  6  8    Sec. 11.  FLOODPLAIN PERMIT BACKLOG.  Notwithstanding any
  6  9 contrary provision of state law, for the fiscal year beginning
  6 10 July 1, 2003, and ending June 30, 2004, the department of
  6 11 natural resources may use additional funds available to the
  6 12 department from stormwater discharge permit fees for the
  6 13 staffing of the following additional full-time staff members
  6 14 to reduce the department's floodplain permit backlog:  
  6 15 ............................................... FTEs       2.00
  6 16    Sec. 12.  IMPLEMENTATION OF THE FEDERAL TOTAL MAXIMUM DAILY
  6 17 LOAD PROGRAM.  Notwithstanding any contrary provision of state
  6 18 law, for the fiscal year beginning July 1, 2003, and ending
  6 19 June 30, 2004, the department of natural resources may use
  6 20 additional funds available to the department from stormwater
  6 21 discharge permit fees for the staffing of the following
  6 22 additional full-time equivalent positions for implementation
  6 23 of the federal total maximum daily load program:
