1 1 Section 1. Section 335.2, Code 2003, is amended to read as
1 2 follows:
1 3 335.2 FARMS EXEMPT.
1 4 Except to the extent required to implement section 335.27,
1 5 and except for an ordinance regulating the setback of
1 6 buildings and structures from the highway right-of-way, no
1 7 ordinance adopted under this chapter applies to land, farm
1 8 houses, farm barns, farm outbuildings or other buildings or
1 9 structures which are primarily adapted, by reason of nature
1 10 and area, for use for agricultural purposes, while so used.
1 11 However, the ordinances may apply to any structure, building,
1 12 dam, obstruction, deposit or excavation in or on the flood
1 13 plains of any river or stream.
1 14 EXPLANATION
1 15 This bill amends Code section 335.2, which exempts farms
1 16 from county zoning ordinances, by creating an exception for
1 17 ordinances regulating the setback of buildings and structures
1 18 from the highway right-of-way. The exception also applies to
1 19 farms within unincorporated areas subject to city zoning
1 20 ordinances.
