PAG LIN 1 1 Section 1. Section 321.438, subsection 2, Code 2003, is 1 2 amended to read as follows: 1 3 2. A person shall not operate on the highway a motor 1 4 vehicle equipped with a front windshield, a side window to the 1 5 immediate right or left of the driver, or a side-wing forward 1 6 of and to the left or right of the driver which is excessively 1 7 dark or reflective so that it is difficult for a person 1 8 outside the motor vehicle to see into the motor vehicle 1 9 through the windshield, window, or sidewing, unless the person 1 10 requires dark windows for medical reasons and has been 1 11 exempted pursuant to rules adopted by the department.The1 12department shall adopt rules establishing a minimum measurable1 13standard of transparency which shall apply to violations of1 14this subsection.For purposes of this subsection, 1 15 "excessively dark or reflective" means that the level of light 1 16 transmittance is less than eighty percent. 1 17 EXPLANATION 1 18 This bill amends Code section 321.438 to require that the 1 19 windshield, front side windows, and front sidewings of a motor 1 20 vehicle have a light transmittance level of at least 80 1 21 percent. A motor vehicle operator who violates this 1 22 requirement is subject to a scheduled fine of $15. A person 1 23 may be exempted from the requirement for medical reasons 1 24 pursuant to rules adopted by the state department of 1 25 transportation. Currently, the minimum measurable standard of 1 26 transparency of 70 percent and the requirements for a medical 1 27 exemption are established by administrative rule as required 1 28 by Code section 321.438. 1 29 LSB 2695SS 80 1 30 dea/sh/8
