1 1 Section 1. Section 341A.18, Code 2003, is amended by
1 2 adding the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. A person holding a position
1 4 subject to civil service who is elected to a city or county
1 5 office in law enforcement or public safety shall, upon written
1 6 application of the employer of that person, be granted a leave
1 7 of absence from regular employment to serve in that office for
1 8 a period of time not to exceed ten years.
1 9 Sec. 2. Section 400.29, Code 2003, is amended by adding
1 10 the following new subsection:
1 11 NEW SUBSECTION. 5. A person holding a position subject to
1 12 civil service who is elected to a city or county office in law
1 13 enforcement or public safety shall, upon written application
1 14 of the employer of that person, be granted a leave of absence
1 15 from regular employment to serve in that office for a period
1 16 of time not to exceed ten years.
1 17 Sec. 3. APPLICABILITY. This Act applies to persons
1 18 elected on or after the effective date of this Act.
1 19 EXPLANATION
1 20 This bill provides that a city or county civil service
1 21 employee who is elected to a city or county office in law
1 22 enforcement or public safety shall be granted a leave of
1 23 absence of not more than 10 years to serve in that elective
1 24 office.
1 25 County civil service employees are deputy sheriffs, with
1 26 some exceptions. City civil service employees are permanent
1 27 full-time police officers and fire fighters in cities with a
1 28 population of more than 8,000. In cities with a population of
1 29 more than 15,000, civil service employees are appointive
1 30 permanent full-time employees, with some exceptions.
1 31 Current law generally allows a leave of absence of no more
1 32 than six years for service in elective office.
1 33 The bill applies to persons elected on or after the
1 34 effective date of the bill.
