1 1 Section 1. Section 23A.2, subsection 2, paragraph a, Code
1 2 2003, is amended to read as follows:
1 3 a. Goods and services that are directly and reasonably
1 4 related to the educational mission of an institution or
1 5 school, except for durable medical equipment offered for
1 6 retail sale to the public or medical services where the state
1 7 board of regents or a school corporation is in competition
1 8 with a private provider.
1 9 EXPLANATION
1 10 This bill prohibits the state board of regents or a school
1 11 corporation from competing with private enterprise relating to
1 12 the sale of medical services where the state board of regents
1 13 or the school corporation is in competition with a private
1 14 provider, or when the goods involved are durable medical
1 15 equipment offered at retail sale to the public. A school
1 16 corporation includes school districts, area education
1 17 agencies, and community colleges.
