PAG LIN 1 1 SENATE FILE 127 1 2 1 3 AN ACT 1 4 ESTABLISHING A SPECIAL BREAST CANCER AWARENESS MOTOR 1 5 VEHICLE REGISTRATION PLATE AND APPROPRIATING FEES FROM SUCH 1 6 PLATES FOR BREAST CANCER SCREENING. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 321.34, Code 2003, is amended by adding 1 11 the following new subsection: 1 12 NEW SUBSECTION. 23. BREAST CANCER AWARENESS PLATES. 1 13 a. Upon application and payment of the proper fees, the 1 14 director may issue breast cancer awareness plates to an owner 1 15 of a motor vehicle referred to in subsection 12. 1 16 b. Breast cancer awareness plates shall contain an image 1 17 of a pink ribbon and shall be designed by the department in 1 18 consultation with the Susan G. Komen foundation. 1 19 c. The special fee for letter number designated breast 1 20 cancer awareness plates is thirty-five dollars. The fee for 1 21 personalized breast cancer awareness plates is twenty-five 1 22 dollars, which shall be paid in addition to the special breast 1 23 cancer awareness fee of thirty-five dollars. The fees 1 24 collected by the director under this subsection shall be paid 1 25 monthly to the treasurer of state and credited to the road use 1 26 tax fund. Notwithstanding section 423.24, and prior to the 1 27 crediting of revenues to the road use tax fund under section 1 28 423.24, subsection 1, paragraph "b", the treasurer of state 1 29 shall transfer monthly from those revenues to the Iowa 1 30 department of public health the amount of the special fees 1 31 collected in the previous month for the breast cancer 1 32 awareness plates and such funds are appropriated to the Iowa 1 33 department of public health. The Iowa department of public 1 34 health shall distribute one hundred percent of the funds 1 35 received monthly in the form of grants to support breast 2 1 cancer screenings for both men and women who meet eligibility 2 2 requirements like those established by the Susan G. Komen 2 3 foundation. In the awarding of grants, the Iowa department of 2 4 public health shall give first consideration to affiliates of 2 5 the Susan G. Komen foundation and similar nonprofit 2 6 organizations providing for breast cancer screenings at no 2 7 cost in Iowa. Notwithstanding section 8.33, moneys 2 8 transferred under this subsection shall not revert to the 2 9 general fund of the state. 2 10 d. Upon receipt of the special registration plates, the 2 11 applicant shall surrender the current registration receipt and 2 12 plates to the county treasurer. The county treasurer shall 2 13 validate the special registration plates in the same manner as 2 14 regular registration plates are validated under this section. 2 15 The annual special breast cancer awareness fee for letter 2 16 number designated plates is ten dollars, which shall be paid 2 17 in addition to the regular annual registration fee. The 2 18 annual special fee for personalized breast cancer awareness 2 19 plates is five dollars, which shall be paid in addition to the 2 20 annual special breast cancer awareness fee and the regular 2 21 annual registration fee. The annual special breast cancer 2 22 awareness fee shall be credited and transferred as provided 2 23 under paragraph "c". 2 24 2 25 2 26 2 27 MARY E.
