  1  4 PROVIDING FOR THE CONFIDENTIALITY OF CERTAIN VETERANS' RECORDS
  1  5    MAINTAINED BY COUNTY RECORDERS.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 22.7, Code 2003, is amended by adding
  1 10 the following new subsection:
  1 11    NEW SUBSECTION.  47.  Military personnel records recorded
  1 12 by the county recorder pursuant to section 331.608.
  1 13    Sec. 2.  Section 331.608, Code 2003, is amended by adding
  1 14 the following new subsection:
  1 15    NEW SUBSECTION.  5A.  Unless otherwise provided by the
  1 16 person who requested the recording of a record under this
  1 17 section, notwithstanding section 22.2, subsection 1, such
  1 18 record shall be confidential and shall not be made available
  1 19 for examination or copying except as follows:
  1 20    a.  To the person who is the subject of the record, to a
  1 21 member of that person's immediate family, or to that person's
  1 22 agent or representative duly authorized in writing.
  1 23    b.  To a person requesting to examine or copy a record when
  1 24 the event that resulted in the record being made occurred more
  1 25 than seventy-five years prior to the request.
  1 26    c.  To a person who is a funeral director licensed pursuant
  1 27 to chapter 156 and who has custody of the body of a deceased
  1 28 veteran.
  1 29    d.  When otherwise ordered by a court of competent
  1 30 jurisdiction.
  1 31    e.  When otherwise required by a department or agency of
  1 32 the federal or state government or a political subdivision
  1 33 thereof.
  1 34    f.  To a person conducting research who has received
  1 35 written approval from the county commissioner of veteran
  2  1 affairs to view the records.
  2  2    Sec. 3.  Section 331.608, subsection 6, Code 2003, is
  2  3 amended to read as follows:
  2  4    6.  If a certified copy of a public record is required to
  2  5 perfect the claim of a veteran in service or honorably
  2  6 discharged or a claim of a dependent of the veteran, the
  2  7 certified copy shall be furnished by the custodian of the
  2  8 public record without charge.
