  1  1    Amend Senate File 2298 as follows:
  1  2    #1.  Page 167, by striking lines 10 through 15.
  1  3    #2.  Page 167, by inserting before line 16 the
  1  4 following:
  1  5    "Sec.    .  Section 13B.4, subsection 2, Code
  1  6 Supplement 2003, as amended by 2004 Iowa Acts, House
  1  7 File 2138, section 1, if enacted, is amended to read
  1  8 as follows:
  1  9    2.  The state public defender shall file a notice
  1 10 with the clerk of the district court in each county
  1 11 served by a public defender designating which public
  1 12 defender office shall receive notice of appointment of
  1 13 cases.  The state public defender may also designate a
  1 14 nonprofit organization which contracts has a contract
  1 15 with the state public defender to provide legal
  1 16 services to eligible indigent persons prior to the
  1 17 effective date of this Act.  Except as otherwise
  1 18 provided, in each county in which the state public
  1 19 defender files a designation, the state public
  1 20 defender's designee shall be appointed by the court to
  1 21 represent all eligible indigents, in all of the cases
  1 22 and proceedings specified in the designation.  The
  1 23 appointment shall not be made if the state public
  1 24 defender notifies the court that the public defender
  1 25 designee will not provide legal representation in
  1 26 certain cases as identified in the designation by the
  1 27 state public defender."
  1 28    #3.  By striking page 171, line 27, through page
  1 29 172, line 9.
  1 30    #4.  Page 174, by inserting after line 34 the
  1 31 following:
  1 32    "Sec.    .  STATE PUBLIC DEFENDER STUDY.  The state
  1 33 public defender in consultation with the indigent
  1 34 defense advisory commission, the supreme court, the
  1 35 Iowa state bar association, the Iowa association of
  1 36 criminal defense lawyers, and other interested
  1 37 organizations, shall study cost saving methods that
  1 38 can be implemented to deliver legal representation to
  1 39 indigent defendants in a more efficient manner.  The
  1 40 state public defender, in cooperation with the
  1 41 entities consulted with, shall file a report with the
  1 42 general assembly by December 15, 2004.  The report
  1 43 shall include recommendations for achieving
  1 44 efficiencies in the delivery of indigent defense
  1 45 services including but not limited to the advisability
  1 46 of the state public defender entering into indigent
  1 47 defense contracts for a predetermined fee in specific
  1 48 types of cases."
