  1  1    Amend Senate File 2298 as follows:
  1  2    #1.  Page 177, by inserting after line 3 the
  1  3 following:
  1  4    "Sec.    .  Section 8.55, subsection 2, paragraph
  1  5 d, Code Supplement 2003, is amended to read as
  1  6 follows:
  1  7    d.  Notwithstanding paragraph "a", any moneys in
  1  8 excess of the maximum balance in the economic
  1  9 emergency fund after the distribution of the surplus
  1 10 in the general fund of the state at the conclusion of
  1 11 each fiscal year and after the appropriate amounts
  1 12 have been transferred pursuant to paragraphs "b" and
  1 13 "c" shall not be transferred to the general fund of
  1 14 the state but shall be transferred to the endowment
  1 15 for Iowa's health account of the tobacco settlement
  1 16 trust fund.  The total amount transferred, in the
  1 17 aggregate, under this paragraph for all fiscal years
  1 18 shall not exceed the difference between one hundred
  1 19 one thirty-one million seven five hundred fifty-one
  1 20 thirty-six thousand dollars and the amounts
  1 21 transferred to the endowment for Iowa's health account
  1 22 to repay the amounts transferred or appropriated from
  1 23 the endowment for Iowa's health account in 2002 Iowa
  1 24 Acts, chapter 1165, 2002 Iowa Acts, chapter 1166, 2002
  1 25 Iowa Acts, chapter 1167, 2002 Iowa Acts, Second
  1 26 Extraordinary Session, chapter 1003, and 2003 Iowa
  1 27 Acts, chapter 183, and 2004 Iowa Acts, Senate File
  1 28 2298."
