PAG LIN 1 1 Amend Senate File 2298 as follows: 1 2 #1. Page 64, by inserting after line 25 the 1 3 following: 1 4 "Sec. . Section 279.8, Code 2003, is amended to 1 5 read as follows: 1 6 279.8 GENERALRULES BONDS OF EMPLOYEES1 7 REQUIREMENTS. 1 8 1. GOVERNMENT PROPERTY. The board shall make 1 9 rules for its own government and that of the 1 10 directors, officers, employees, teachers, and pupils, 1 11 and for the care of the schoolhouse, grounds, and 1 12 property of the school corporation, and shall aid in 1 13 the enforcement of the rules, and require the 1 14 performance of duties imposed by law and the rules. 1 15 2. SCHOOL BUS LOADING AND UNLOADING. The board 1 16 shall include in its rules provisions regulating the 1 17 loading and unloading of pupils from a school bus 1 18 stopped on the highway during a period of reduced 1 19 highway visibility caused by fog, snow, or other 1 20 weather conditions. 1 21 3. SCHOOL CREDIT CARDS. The board shall have the 1 22 authority to include in its rules provisions allowing 1 23 school corporation employees to use school credit 1 24 cards to pay for the actual and necessary expenses 1 25 incurred in the performance of work-related duties. 1 26 4. BONDS OF EMPLOYEES. Employees of a school 1 27 corporation maintaining a high school who have the 1 28 custody of funds belonging to the corporation or funds 1 29 derived from extracurricular activities and other 1 30 sources in the conduct of their duties, shall be 1 31 required to furnish suitable bond indemnifying the 1 32 corporation or any activity group connected with the 1 33 school against loss, and employees who have the 1 34 custody of property belonging to the corporation or 1 35 any activity group connected with the school may be 1 36 required to furnish such bond.SaidSuch bond or 1 37 bonds may be in such form and penalty as the board may 1 38 approve and the premiums onsamethe bond or bonds 1 39 shall be paid from the general fund of the 1 40 corporation. 1 41 5. ANTIBULLYING AND ANTIHARASSMENT POLICY. The 1 42 board of directors of each school district shall adopt 1 43 and annually review a policy prohibiting bullying and 1 44 harassment of all students based on any real or 1 45 perceived characteristic, including, but not limited 1 46 to, age, color, creed, national origin, race, 1 47 religion, marital status, sex, sexual orientation, 1 48 gender identity, physical attributes, physical or 1 49 mental ability or disability, ancestry, political 1 50 party preference, socioeconomic status, or familial 2 1 status. The policy shall be developed with local 2 2 input from parents, guardians, school employees, 2 3 volunteers, students, school administrators, and other 2 4 members of the community. The school board shall 2 5 annually review the policy with parents, guardians, 2 6 school employees, volunteers, students, school 2 7 administrators, and other members of the community. 2 8 The policy shall, at a minimum, include or provide for 2 9 all of the following: 2 10 a. A definition of bullying and harassment which 2 11 shall be construed to mean the same and defined to 2 12 mean any conduct toward a student that is based on any 2 13 real or perceived characteristic, including, but not 2 14 limited to, age, color, creed, national origin, race, 2 15 religion, marital status, sex, sexual orientation, 2 16 gender identity, physical attributes, physical or 2 17 mental ability or disability, ancestry, political 2 18 party preference, socioeconomic status, or familial 2 19 status, and that creates an objectively hostile school 2 20 environment which meets any of the following 2 21 conditions: 2 22 (1) Places the student in reasonable fear of harm 2 23 to the student's person or property. 2 24 (2) Has a substantially detrimental effect on the 2 25 student's physical or mental health. 2 26 (3) Has the effect of substantially interfering 2 27 with a student's academic performance. 2 28 (4) Has the effect of substantially interfering 2 29 with the student's ability to participate in or 2 30 benefit from the services, activities, or privileges 2 31 provided by a school. 2 32 b. Effective prevention strategies and 2 33 professional development for teachers and 2 34 administrators. 2 35 c. Monitoring and evaluation of the policy's 2 36 effectiveness and inclusion in the comprehensive 2 37 school improvement plan filed with the department of 2 38 education in accordance with section 256.7, subsection 2 39 21. 2 40 d. Procedures for receiving and responding to 2 41 complaints. 2 42 e. Consequences and appropriate remedial action 2 43 for violation of the policy, taking into account the 2 44 pattern and severity of particular bullying and 2 45 harassing behavior. 2 46 f. Public notice of the policy. 2 47 g. Prohibition of reprisals or retaliation against 2 48 any person who reports bullying or harassing behavior. 2 49 Each school board shall develop procedures 2 50 necessary to implement and administer this 3 1 subsection." 3 2 #2.
