  1  1    Amend Senate File 2070 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  Section 321.1, subsection 20B, Code
  1  5 Supplement 2003, is amended to read as follows:
  1  6    20B.  "Electric personal assistive mobility device"
  1  7 means a self-balancing, nontandem two-wheeled device
  1  8 powered by an electric propulsion system that averages
  1  9 seven hundred fifty watts, has two nontandem wheels,
  1 10 and is designed to transport one person, with a
  1 11 maximum speed on a paved level surface of less than
  1 12 twenty miles per hour.  The maximum speed shall be
  1 13 calculated based on operation of the device by a
  1 14 person who weighs one hundred seventy pounds when the
  1 15 device is powered solely by the electric propulsion
  1 16 system.  For purposes of this chapter, "electric
  1 17 personal assistive mobility device" does not include
  1 18 an assistive device as defined in section 216E.1."
  1 19    #2.  Page 19, by inserting after line 3 the
  1 20 following:
  1 21    "Sec.    .  Section 321.235A, unnumbered paragraph
  1 22 1, Code 2003, is amended to read as follows:
  1 23    An electric personal assistive mobility device,
  1 24 which is a two-wheeled device as defined in section
  1 25 321.1, subsection 20B, may be operated by a person at
  1 26 least sixteen years of age on sidewalks and bikeways
  1 27 in accordance with this section."
  1 28    #3.  Page 20, by inserting after line 23 the
  1 29 following:
  1 30    "5.  The sections of this Act amending section
  1 31 321.1, subsection 20B, and section 321.235A,
  1 32 unnumbered paragraph 1, being deemed of immediate
  1 33 importance, take effect upon enactment."
  1 34    #4.  Page 20, line 24, by striking the figure "5."
  1 35 and inserting the following:  "6."
  1 36    #5.  Title page, line 3, by inserting after the
  1 37 word "vehicles" the following:  ", regulation of
  1 38 electric personal assistive mobility devices,".
  1 39    #6.  By renumbering as necessary.
