1 1 Amend the amendment, S-3391, to House File 692, as
1 2 amended, passed, and reprinted by the House, as
1 3 follows:
1 4 #1. Page 44, line 44, by inserting after the word
1 5 "percent" the following: "more than the projected
1 6 levels using economic projections and indicators".
1 7 #2. Page 45, by inserting after line 10 the
1 8 following:
1 9 "(9) A net increase in the number of jobs in each
1 10 industry sector in Iowa."
1 11 #3. Page 46, by inserting after line 48 the
1 12 following:
1 13 "All financial assistance to businesses receiving
1 14 moneys from the fund shall be in the form of loans. A
1 15 loan may be forgiven if the board and the department
1 16 both find that all of the following conditions exist:
1 17 1. More than five years has expired since the
1 18 recipient entered into the original loan agreement for
1 19 the moneys.
1 20 2. The recipient met all conditions and goals
1 21 established in the original loan agreement. The goals
1 22 must include a net increase of at least one permanent
1 23 quality job, as defined by the department, per every
1 24 ten thousand dollars received. The net increase must
1 25 be measured by both a net increase in permanent
1 26 quality jobs within the business and within the
1 27 industry in Iowa of which the recipient is included.
1 28 3. The business has not demonstrated a continuous
1 29 and flagrant disregard for the health and safety of
1 30 its employees or the quality of the environment.
1 31 Evidence of such disregard shall include a history of
1 32 serious or uncorrected violations of state or federal
1 33 law protecting occupational health and safety or the
1 34 environment, including but not limited to serious or
1 35 uncorrected violations of occupational safety and
1 36 health standards enforced by the division of labor
1 37 services of the department of workforce development
1 38 pursuant to chapter 84A, or rules enforced by the
1 39 department of natural resources pursuant to chapter
1 40 455B or chapter 459, subchapter II or III."
