PAG LIN 1 1 Amend Senate File 458 as follows: 1 2 #1. Page 6, by inserting after line 11 the 1 3 following: 1 4 "Sec. . FEDERAL FISCAL RELIEF FUNDING. If the 1 5 one hundred eighth United States Congress enacts an 1 6 economic stimulus package that includes the provision 1 7 of discretionary funding to the state to provide state 1 8 or local government fiscal relief, the funding shall 1 9 be deposited in the fund created by section 8.41." 1 10 #2. Page 15, by inserting after line 26 the 1 11 following: 1 12 "Sec. . 2003 Iowa Acts, House File 289, section 1 13 1, is amended by striking the section and inserting in 1 14 lieu thereof the following: 1 15 SECTION 1. Section 12C.1, subsection 2, paragraph 1 16 e, Code 2003, as amended by 2003 Iowa Acts, Senate 1 17 File 395, is amended by adding the following new 1 18 subparagraph: 1 19 NEW SUBPARAGRAPH. (6) Moneys placed in a 1 20 depository for the purpose of completing an electronic 1 21 financial transaction pursuant to section 8A.222 or 1 22 331.427." 1 23 #3. Page 16, by inserting after line 25 the 1 24 following: 1 25 "Sec. . Section 99G.10, subsection 2, if 1 26 enacted by 2003 Iowa Acts, Senate File 453, section 1 27 72, is amended to read as follows: 1 28 2. Subject to the approval of the board, the chief 1 29 executive officer shall have the sole power to 1 30 designate particular employees as key personnel, but 1 31 may take advice from the department of personnel in 1 32 making any such designations. All key personnel shall 1 33 be exempt from the merit system described in chapter 1 3419A8A, article 4. The chief executive officer and 1 35 the board shall have the sole power to employ, 1 36 classify, and fix the compensation of key personnel. 1 37 All other employees shall be employed, classified, and 1 38 compensated in accordance withchapters 19Achapter 1 39 8A, article 4, and chapter 20. 1 40 Sec. . Section 99G.22, subsection 1, if enacted 1 41 by 2003 Iowa Acts, Senate File 453, is amended to read 1 42 as follows: 1 43 1. The authority shall investigate the financial 1 44 responsibility, security, and integrity of any lottery 1 45 system vendor who is a finalist in submitting a bid, 1 46 proposal, or offer as part of a major procurement 1 47 contract. Before a major procurement contract is 1 48 awarded, the division of criminal investigation of the 1 49 department of public safety shall conduct a background 1 50 investigation of the vendor to whom the contract is to 2 1 be awarded. The chief executive officer and board 2 2 shall consult with the division of criminal 2 3 investigation and shall provide for the scope of the 2 4 background investigation and due diligence to be 2 5 conducted in connection with major procurement 2 6 contracts. At the time of submitting a bid, proposal, 2 7 or offer to the authority on a major procurement 2 8 contract, the authority shall require that each vendor 2 9 submit to the division of criminal investigation 2 10 appropriate investigation authorization to facilitate 2 11 this investigation, together with an advance of funds 2 12 to meet the anticipated investigation costs. If the 2 13 division of criminal investigation determines that 2 14 additional funds are required to complete an 2 15 investigation, the vendor will be so advised. The 2 16 background investigation by the division of criminal 2 17 investigation may include a national criminal history 2 18recordcheck through the federal bureau of 2 19 investigation. The screening of vendors or their 2 20 employees through the federal bureau of investigation 2 21 shall be conducted by submission of fingerprints 2 22 through the state criminal historyrecordrepository 2 23 to the federal bureau of investigation. 2 24 Sec. . Section 99G.37, subsection 2, if enacted 2 25 by 2003 Iowa Acts, Senate File 453, section 90, is 2 26 amended to read as follows: 2 27 2. In any bidding process, the authority may 2 28 administer its own bidding and procurement or may 2 29 utilize the services of the department ofgeneral2 30 administrative services, or its successor,or other 2 31 state agency. 2 32 Sec. . Section 99G.38, subsection 3, if enacted 2 33 by 2003 Iowa Acts, Senate File 453, section 91, is 2 34 amended to read as follows: 2 35 3. The state of Iowa offset program, as provided 2 36 in section421.178A.504, shall be available to the 2 37 authority to facilitate receipt of funds owed to the 2 38 authority." 2 39 #4. Page 17, by inserting after line 16 the 2 40 following: 2 41 "Sec. . Section 231.56A, if enacted by 2003 2 42 Iowa Acts, Senate File 416, section 1, is amended to 2 43 read as follows: 2 44 231.56A ELDER ABUSE INITIATIVE, EMERGENCY SHELTER, 2 45 AND SUPPORT SERVICES PROJECTS. 2 46 1. Through the state's service contract process 2 47 adopted pursuant to section 8.47, the department shall 2 48 identify area agencies on aging that have demonstrated 2 49 the ability to provide a collaborative response to the 2 50 immediate needs of elders in the area agency on aging 3 1 service area for the purpose of implementing elder 3 2 abuse initiative, emergency shelter, and support 3 3 services projects. The projects shall be implemented 3 4 only in the counties within an area agency on aging 3 5 service area that have a multidisciplinary team 3 6 established pursuant to section 235B.1. 3 7 2. The target population of the projects shall be 3 8 any elder residing in the service area of an area 3 9 agency on aging who meets both of the following 3 10 conditions: 3 11 a. Is the subject of a report of suspected 3 12 dependent adult abuse pursuant to chapter 235B. 3 13 b. Is not receiving assistance under a county 3 14 management plan approved pursuant to section 331.439. 3 15 3. The area agencies on aging implementing the 3 16 projects shall identify allowable emergency shelter 3 17 and support services, state funding, outcomes, 3 18 reporting requirements, and approved community 3 19 resources from which services may be obtained under 3 20 the projects. The area agency on aging shall identify 3 21 at least one provider of case management services for 3 22 the project area. 3 23 4. The area agencies on aging shall implement the 3 24 projects and shall coordinate the provider network 3 25 through the use of referrals or other engagement of 3 26 community resources to provide services to elders. 3 27 5. The department shall award funds to the area 3 28 agencies on aging in accordance with the state's 3 29 service contract process. Receipt and expenditures of 3 30 moneys under the projects are subject to examination, 3 31 including audit, by the department. 3 32 6. This section shall not be construed and is not 3 33 intended as, and shall not imply, a grant of 3 34 entitlement for services to individuals who are not 3 35 otherwise eligible for the services or for utilization 3 36 of services that do not currently exist or are not 3 37 otherwise available." 3 38 #5. Page 18, by inserting after line 8 the 3 39 following: 3 40 "Sec. . Section 321.69, subsection 9, as 3 41 amended by 2003 Acts, House File 502, section 3, is 3 42 amended to read as follows: 3 43 9.ThisExcept for subsection 9A, this section 3 44 does not apply to motor trucks and truck tractors with 3 45 a gross vehicle weight rating of sixteen thousand 3 46 pounds or more, vehicles more than nine model years 3 47 old, motorcycles, motorized bicycles, and special 3 48 mobile equipment. This section does apply to motor 3 49 homes. The requirement in subsection 1 that the new 3 50 certificate of title and registration receipt shall 4 1 state on the face of the title the total cumulative 4 2 dollar amount of damage does not apply to a vehicle 4 3 with a certificate of title bearing a designation that 4 4 the vehicle was previously titled on a salvage 4 5 certificate of title pursuant to section 321.52, 4 6 subsection 4, paragraph "b", or to a vehicle with a 4 7 certificate of title bearing a "REBUILT" or "SALVAGE" 4 8 designation pursuant to section 321.24, subsection 4 4 9 or 5.ThisExcept for subsection 9A, this section 4 10 does not apply to new motor vehicles with a true 4 11 mileage, as defined in section 321.71, of one thousand 4 12 miles or less, unless such vehicle has incurred damage 4 13 as defined in subsection 2." 4 14 #6. Page 20, by inserting after line 13 the 4 15 following: 4 16 "Sec. . 2003 Iowa Acts, Senate File 453, 4 17 section 44, subsection 8, if enacted, is amended to 4 18 read as follows: 4 19 8. STATUTORY REQUIREMENTS. The requirements of 4 20 sections18.68A.311 and 72.3 and the administrative 4 21 rules implementing section 8.47 are not applicable to 4 22 the services procurement process used to implement the 4 23 outcomes-based service system redesign in accordance 4 24 with this section. The department of human services 4 25 may enter into competitive negotiations and proposal 4 26 modifications with each successful contractor as 4 27 necessary to implement the provisions of this 4 28 section." 4 29 #7. The sections of this division of this Act 4 32 amending sections 12C.1, 99G.10, 99G.37, and 99G.38 4 33 take effect only if House File 534 is enacted by the 4 34 Eightieth General Assembly, 2003 Regular Session." 4 35 #8.
