PAG LIN 1 1 Amend Senate File 344 as follows: 1 2 #1. Page 44, by inserting after line 25 the 1 3 following: 1 4 "Sec. . Section 455B.133, subsection 4, 1 5 unnumbered paragraph 1, Code 2003, is amended to read 1 6 as follows: 1 7 Adopt, amend, or repeal emission limitations or 1 8 standards relating to the maximum quantities of air 1 9 contaminants that may be emitted from any air 1 10 contaminant source. The standards or limitations 1 11 adopted under this section shall not exceed the 1 12 standards or limitations promulgated by the 1 13 administrator of the United States environmental 1 14 protection agency or the requirements of the federal 1 15 Clean Air Act as amended through January 1, 1991, or 1 16 air quality standards or limitations promulgated by 1 17 the United States occupational safety and health 1 18 administration.ThisWith the exception of ambient 1 19 air standards, this does not prohibit the commission 1 20 from adopting a standard for a source or class of 1 21 sources for which the United States environmental 1 22 protection agency or the United States occupational 1 23 safety and health administration has not promulgated a 1 24 standard. If the United States environmental 1 25 protection agency has not promulgated ambient air 1 26 quality standards, this section shall not prohibit the 1 27 commission from adopting an ambient air standard if 1 28 the commission utilizes established federal Clean Air 1 29 Act methodologies under the national ambient air 1 30 quality standards program. The methodology shall 1 31 include an economic impact study to ascertain costs 1 32 associated with compliance with any proposed 1 33 standards. This also does not prohibit the commission 1 34 from adopting an emission standard or limitation for 1 35 infectious medical waste treatment or disposal 1 36 facilities which exceeds the standards or limitations 1 37 promulgated by the administrator of the United States 1 38 environmental protection agency or the requirements of 1 39 the federal Clean Air Act as amended through January 1 40 1, 1991. The commission shall not adopt an emission 1 41 standard or limitation for infectious medical waste 1 42 treatment or disposal facilities prior to January 1, 1 43 1995, which exceeds the standards or limitations 1 44 promulgated by the administrator of the United States 1 45 environmental protection agency or the requirements of 1 46 the federal Clean Air Act, as amended through January 1 47 1, 1991, for a hospital, or a group of hospitals, 1 48 licensed under chapter 135B which has been operating 1 49 an infectious medical waste treatment or disposal 1 50 facility prior to January 1, 1991." 2 1 #2.
