  1  1    Amend Senate File 327 as follows:
  1  2    #1.  Page 1, by striking lines 4 through 6 and
  1  3 inserting the following:  "the commission.  However,
  1  4 for racetrack enclosures, "gambling game" does not
  1  5 include table games of chance or video machines.
  1  6 "Gambling game" does not include sports betting."
  1  7    #2.  Page 4, by striking lines 7 through 12 and
  1  8 inserting the following:  "receipts over three million
  1  9 dollars.  However, beginning January 1, 1997 2003, the
  1 10 rate on any amount of adjusted gross receipts over
  1 11 three million dollars from gambling games at racetrack
  1 12 enclosures is twenty-two twenty-eight percent and
  1 13 shall increase by two percent each succeeding calendar
  1 14 year until the rate is thirty-six percent.  The taxes
  1 15 imposed by this section shall".
  1 16    #3.  Page 4, by inserting after line 15 the
  1 17 following:
  1 18    "Sec.    .  EFFECTIVE DATE – RETROACTIVE
  1 19 APPLICABILITY.  The section of this Act amending
  1 20 section 99F.11, being deemed of immediate importance,
  1 21 takes effect upon enactment and is retroactively
  1 22 applicable to January 1, 2003, and is applicable on
  1 23 and after that date."
  1 24    #4.  Title page, line 6, by inserting after the
  1 25 word "games" the following:  ", and including
  1 26 effective and retroactive applicability provisions".
  1 27    #5.  By renumbering as necessary.
