  1  1    Section 1.  Section 260C.14, Code Supplement 2003, is
  1  2 amended by adding the following new subsection:
  1  3    NEW SUBSECTION.  21.  Adopt rules to deem an individual a
  1  4 resident of this state for tuition and fee purposes, until the
  1  5 individual establishes a residence outside this state, if the
  1  6 individual resided with a parent or guardian while attending
  1  7 an accredited high school in this state, and meets all of the
  1  8 following conditions:
  1  9    a.  The individual graduated from an accredited high school
  1 10 in this state or received a high school equivalency diploma in
  1 11 this state.
  1 12    b.  The individual resided in this state at least three
  1 13 years as of the date the individual graduated from an
  1 14 accredited high school or received a high school equivalency
  1 15 diploma in this state.
  1 16    c.  The individual enrolls in the community college not
  1 17 earlier than the 2004 fall semester.
  1 18    d.  In the case of an individual who is not a citizen or
  1 19 permanent resident of the United States, the individual
  1 20 provides the community college with an affidavit stating that
  1 21 the individual will file an application to become a permanent
  1 22 resident of the United States at the earliest opportunity the
  1 23 individual is eligible to do so.
  1 24    This subsection shall not be construed to prohibit a
  1 25 community college from establishing or maintaining a less
  1 26 stringent policy for the establishment of Iowa residency by a
  1 27 United States citizen or national of a foreign country.
  1 28    Sec. 2.  Section 262.9, Code Supplement 2003, is amended by
  1 29 adding the following new subsection:
  1 30    NEW SUBSECTION.  32.  Adopt rules to deem an individual a
  1 31 resident of this state for tuition and fee purposes, until the
  1 32 individual establishes a residence outside this state, if the
  1 33 individual resided with a parent or guardian while attending
  1 34 an accredited high school in this state, and meets all of the
  1 35 following conditions:
  2  1    a.  The individual graduated from an accredited high school
  2  2 in this state or received a high school equivalency diploma in
  2  3 this state.
  2  4    b.  The individual resided in this state at least three
  2  5 years as of the date the individual graduated from an
  2  6 accredited high school or received a high school equivalency
  2  7 diploma in this state.
  2  8    c.  The individual enrolls in an institution of higher
  2  9 learning under the control of the board not earlier than the
  2 10 2004 fall semester.
  2 11    d.  In the case of an individual who is not a citizen or
  2 12 permanent resident of the United States, the individual
  2 13 provides an institution of higher education under the control
  2 14 of the board with an affidavit stating that the individual
  2 15 will file an application to become a permanent resident of the
  2 16 United States at the earliest opportunity the individual is
  2 17 eligible to do so.
  2 18    This subsection shall not be construed to prohibit an
  2 19 institution from establishing or maintaining a less stringent
  2 20 policy for the establishment of Iowa residency by a United
  2 21 States citizen or national of a foreign country.  
  2 22                           EXPLANATION
  2 23    This bill directs the board of directors of a community
  2 24 college and the state board of regents to adopt rules that
  2 25 deem an individual a resident of the state for purposes of
  2 26 tuition and fees if the individual resided with a parent or
  2 27 guardian while attending a high school in this state,
  2 28 graduated from a high school or received a high school
  2 29 equivalency diploma in this state, resided in this state at
  2 30 least three years prior to graduating or receiving a high
  2 31 school equivalency diploma in this state, enrolls in the
  2 32 postsecondary institution in this state not earlier than the
  2 33 2004 fall semester, and, if the individual is not a citizen or
  2 34 a permanent resident of the United States, the individual
  2 35 provides the postsecondary institution of enrollment with an
  3  1 affidavit stating that the individual will file an application
  3  2 to become a permanent resident of the United States at the
  3  3 earliest opportunity the individual is eligible to do so.
