1 1 Section 1. Section 88.16, subsections 1 and 3, Code 2003,
1 2 are amended to read as follows:
1 3 1. The commissioner shall conduct directly or by contract,
1 4 educational programs to provide an adequate supply of
1 5 qualified personnel to administer this chapter and
1 6 informational programs on the importance of and proper use of
1 7 adequate safety and health equipment. In making inspections
1 8 and investigations under this chapter, the commissioner's
1 9 representative shall inspect and investigate only those
1 10 businesses for which the representative received industry-
1 11 specific training.
1 12 3. The commissioner shall provide for the establishment
1 13 and supervision of programs for the education and training of
1 14 employers and employees in the recognition, avoidance, and
1 15 prevention of unsafe or unhealthful working conditions in
1 16 employments covered by this chapter, and consult with and
1 17 advise employers, employees, and organizations representing
1 18 employers and employees, as to effective means of preventing
1 19 occupational injuries and illnesses. The commissioner shall
1 20 increase training and consultation services prior to
1 21 implementation of new standards.
1 22 EXPLANATION
1 23 This bill relates to the occupational safety and health
1 24 provisions of the Code by requiring that the labor
1 25 commissioner's representatives have industry-specific training
1 26 for the businesses they inspect and that the commissioner
1 27 increase training and consultation services prior to the
1 28 implementation of new standards.
