  1  1    Section 1.  Section 99D.11, subsection 7, Code 2003, is
  1  2 amended to read as follows:
  1  3    7.  A person under the age of twenty-one years shall not
  1  4 make or attempt to make a pari-mutuel wager.  A person who
  1  5 violates this subsection commits a scheduled violation under
  1  6 section 805.8C, subsection 4.
  1  7    Sec. 2.  Section 99F.9, subsection 5, Code 2003, is amended
  1  8 to read as follows:
  1  9    5.  A person under the age of twenty-one years shall not
  1 10 make or attempt to make a wager on an excursion gambling boat
  1 11 or in a racetrack enclosure and shall not be allowed in the
  1 12 area of the excursion gambling boat where gambling is being
  1 13 conducted or in the area of a racetrack enclosure where slot
  1 14 machines are operated.  However, a person eighteen years of
  1 15 age or older may be employed to work in a gambling area of an
  1 16 excursion gambling boat or a racetrack enclosure.  A person
  1 17 who violates this subsection with respect to making or
  1 18 attempting to make a wager commits a scheduled violation under
  1 19 section 805.8C, subsection 4.
  1 20    Sec. 3.  NEW SECTION.  725.19  GAMBLING BY MINORS.
  1 21    1.  Any person under the age of twenty-one years shall not
  1 22 make or attempt to make a gambling wager, except as permitted
  1 23 under chapter 99B.  A person who violates this subsection
  1 24 commits a scheduled violation under section 805.8C, subsection
  1 25 4.
  1 26    2.  A person who knowingly permits a person under the age
  1 27 of twenty-one years to make or attempt to make a gambling
  1 28 wager, except as permitted under chapter 99B, is guilty of a
  1 29 simple misdemeanor.
  1 30    Sec. 4.  Section 805.8C, Code 2003, is amended by adding
  1 31 the following new subsection:
  1 32    NEW SUBSECTION.  4.  GAMBLING VIOLATIONS.  For violations
  1 33 of legal age for gambling wagering under section 99D.11,
  1 34 subsection 7, section 99F.9, subsection 5, and section 725.19,
  1 35 subsection 1, the scheduled fine is one hundred dollars.
  2  1 Failure to pay the fine by a person under the age of eighteen
  2  2 shall not result in the person being detained in a secure
  2  3 facility.  
  2  4                           EXPLANATION
  2  5    This bill deals with gambling by persons under the age of
  2  6 21.  The bill provides that it is a scheduled violation for a
  2  7 person under age 21 to make or attempt to make a pari-mutuel
  2  8 wager.  The bill also makes it a scheduled violation for a
  2  9 person under age 21 to make or attempt to make a wager on an
  2 10 excursion gambling boat or at a racetrack enclosure.  The bill
  2 11 further provides that it is a scheduled violation for a person
  2 12 under age 21 to make or attempt to make a gambling wager,
  2 13 except as permitted under Code chapter 99B.  The bill
  2 14 establishes the scheduled fine for these violations at $100.
  2 15 The bill also establishes that a person who knowingly permits
  2 16 a person under age 21 to make or attempt to make a gambling
  2 17 wager, except as permitted under Code chapter 99B, commits a
  2 18 simple misdemeanor.
