PAG LIN 1 1 Section 1. Section 20.4, Code 2003, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 14. Employees of the state racing and 1 4 gaming commission in the positions of equine veterinarian, 1 5 canine veterinarian, and equine steward. 1 6 Sec. 2. Section 99D.6, Code 2003, is amended to read as 1 7 follows: 1 8 99D.6 CHAIRPERSON ADMINISTRATOR EMPLOYEES DUTIES 1 9 BOND. 1 10 The commission shall elect in July of each year one of its 1 11 members chairperson for the succeeding year. The commission 1 12 shall appoint an administrator of the commission subject to 1 13 confirmation by the senate. The administrator shall serve a 1 14 four-year term. The term shall begin and end in the same 1 15 manner as set forth in section 69.19. A vacancy shall be 1 16 filled for the unexpired portion of the term in the same 1 17 manner as a full-term appointment is made. The administrator 1 18 may hire other assistants and employees as necessary to carry 1 19 out the commission's duties. Employees in the positions of 1 20 equine veterinarian, canine veterinarian, and equine steward 1 21 shall be exempt from the merit system provisions of chapter 1 22 8A, subchapter IV. Some or all of the information required of 1 23 applicants in section 99D.8A, subsections 1 and 2, may also be 1 24 required of employees of the commission if the commission 1 25 deems it necessary. The administrator shall keep a record of 1 26 the proceedings of the commission, and preserve the books, 1 27 records, and documents entrusted to the administrator's care. 1 28 Thecommission shall require theadministratorto post a bond1 29in a sum it may fix, conditioned upon the faithful performance1 30of the administrator's dutiesshall be covered by blanket 1 31 surety bond of the state purchased pursuant to section 8A.321, 1 32 subsection 12. Subject to the approval of the governor, the 1 33 commission shall fix the compensation of the administrator 1 34 within the salary range as set by the general assembly. The 1 35 commission shall have its headquarters in the city of Des 2 1 Moines, and shall meet in July of each year and at other times 2 2 and places as it finds necessary for the discharge of its 2 3 duties. 2 4 Sec. 3. EFFECTIVE DATE RETROACTIVE APPLICABILITY. This 2 5 Act takes effect April 1, 2004. If the bill is enacted after 2 6 April 1, 2004, this Act, being deemed of immediate importance, 2 7 takes effect upon enactment and is retroactively applicable to 2 8 April 1, 2004, and is applicable on and after that date. 2 9 EXPLANATION 2 10 This bill provides that employees of the state racing and 2 11 gaming commission in the positions of equine veterinarian, 2 12 canine veterinarian, and equine steward are excluded from the 2 13 provisions of Code chapter 20 governing collective bargaining 2 14 and from the merit system provisions of Code chapter 8A. The 2 15 bill also provides that the administrator of the racing and 2 16 gaming commission will be covered under the blanket surety 2 17 bond purchased by the state instead of being required to post 2 18 a bond based upon an amount fixed by the commission. 2 19 The bill takes effect April 1, 2004. If the bill is 2 20 enacted after this date, the bill is retroactively applicable 2 21 to April 1, 2004. 2 22 LSB 5285DP 80 2 23 ec/pj/5.1
