PAG LIN 1 1 Section 1. Section 17A.4, subsection 3, Code Supplement 1 2 2003, is amended to read as follows: 1 3 3. Any notice of intended action or rule filed without 1 4 notice pursuant to subsection 2,which necessitates additional1 5annual expenditures of at least one hundred thousand dollars1 6or combined expenditures of at least five hundred thousand1 7dollars within five years by all affected persons, including1 8the agency itself, shall be accompanied by a fiscal impact1 9statement outlining the expendituresshall be accompanied by 1 10 an economic impact statement analyzing the impact that notice 1 11 of intended action or rule filed without notice will have on 1 12 all affected persons, including the agency itself. The agency 1 13 shall promptly deliver a copy of the statement to the 1 14 legislative services agency. To the extent feasible, the 1 15 legislative services agency shall analyze the statement and 1 16 provide a summary of that analysis to the administrative rules 1 17 review committee. If the agency has made a good faith effort 1 18 to comply with the requirements of this subsection, the rule 1 19 shall not be invalidated on the ground that the contents of 1 20 the statement are insufficient or inaccurate. 1 21 EXPLANATION 1 22 In the current rulemaking process agencies must analyze the 1 23 expenditures necessitated by a new rule if those expenses 1 24 exceed $100,000 for one year or $500,000 over five years. 1 25 This bill would revise and expand this process by requiring, 1 26 for every new rule, an analysis of the actual economic impact 1 27 that rule will have on the regulated public and the agency 1 28 itself. 1 29 LSB 5430YH 80 1 30 jr/sh/8
