1 1 Section 1. NEW SECTION. 280.28 JOINT LEGAL CUSTODIAL
1 2 PARENTS – SHARING OF STUDENT INFORMATION AND EQUAL
1 3 INVOLVEMENT.
1 4 1. By August 1, 2004, the department of education shall
1 5 adopt a plan, to be implemented by the boards of directors of
1 6 each public school district and the authorities in charge of
1 7 each nonpublic school, to provide for the sharing of student
1 8 information with and involvement in school activities by both
1 9 parents awarded joint legal custody of a student in an equal
1 10 manner, unless the school is provided a copy of a court order,
1 11 decree, or other supporting documentation that prohibits such
1 12 sharing of information or involvement by either parent.
1 13 2. The plan described in subsection 1 shall specifically
1 14 provide for, but shall not be limited to, provision of all of
1 15 the following:
1 16 a. Allowing both parents awarded joint legal custody to
1 17 examine and reproduce all information in the student's school
1 18 record.
1 19 b. Identification of both parents awarded joint legal
1 20 custody as contacts for emergency medical notification.
1 21 c. Receipt of all school calendars by and provision of
1 22 notices to both parents awarded joint legal custody, including
1 23 but not limited to provision of notices for school
1 24 conferences, school events, and extracurricular activities.
1 25 3. For the purposes of this section, "parent awarded joint
1 26 legal custody" means a parent awarded "joint legal custody" as
1 27 defined in section 598.1.
1 28 EXPLANATION
1 29 This bill directs the department of education to adopt a
1 30 plan by August 1, 2004, to be implemented by the boards of
1 31 directors of each public school district and the authorities
1 32 in charge of each nonpublic school, to provide for the sharing
1 33 of student information with and involvement in school
1 34 activities by both joint legal custodial parents of a student
1 35 in an equal manner, unless the school is provided a copy of a
2 1 court order, decree, or other supporting documentation that
2 2 prohibits such sharing of information or involvement by either
2 3 parent.
2 4 The bill specifies certain provisions required to be
2 5 included in the plan developed.
