  1  1    Section 1.  NEW SECTION.  321.179  DRIVER EDUCATION –
  1  2 TEACHING PARENT.
  1  3    1.  TEACHING PARENT.  As an alternative to the driver
  1  4 education requirements under section 321.178, a teaching
  1  5 parent may instruct a student in a driver education course
  1  6 that meets the requirements of this section, and provide
  1  7 certified evidence that the requirements under this section
  1  8 have been met.
  1  9    2.  DEFINITIONS.  For purposes of this section:
  1 10    a.  "Student" means a person between the ages of fourteen
  1 11 and twenty-one years who is within the custody and control of
  1 12 the teaching parent and who satisfies preliminary licensing
  1 13 requirements of the department.
  1 14    b.  "Teaching parent" means a parent or guardian of a
  1 15 student, who holds a current valid Iowa driver's license and
  1 16 is providing competent private instruction to the student
  1 17 pursuant to section 299A.2 or 299A.3.
  1 18    3.  COURSE OF INSTRUCTION.  A driver education course
  1 19 administered by a teaching parent shall consist of, but not be
  1 20 limited to, the following:
  1 21    a.  Thirty clock hours of classroom instruction.
  1 22    b.  Forty hours of street or highway driving including four
  1 23 hours of driving after sunset and before sunrise while
  1 24 accompanied by the teaching parent.
  1 25    c.  Four hours of classroom instruction concerning
  1 26 substance abuse.
  1 27    d.  A minimum of twenty minutes of instruction concerning
  1 28 railroad crossing safety.
  1 29    e.  Instruction relating to becoming an organ donor under
  1 30 the uniform anatomical gift Act.
  1 31    The content of the course of instruction required under
  1 32 this subsection shall be equivalent to that required under
  1 33 section 321.178.  However, reference and study materials,
  1 34 physical classroom requirements, and extra vehicle safety
  1 35 equipment required for instruction under section 321.178 shall
  2  1 not be required for the course of instruction provided under
  2  2 this section.
  2  3    4.  COURSE COMPLETION AND CERTIFICATION.  Upon completion
  2  4 of a course under this section, the teaching parent shall
  2  5 document or provide evidence showing substantial compliance
  2  6 with the requirements of subsection 3 and certify by affidavit
  2  7 to the department of education that the course has been
  2  8 completed.  Documentation shall include all of the following:
  2  9    a.  An affidavit attesting to satisfactory completion of
  2 10 course work and street or highway driving instruction.
  2 11    b.  A listing of subjects presented in classroom training.
  2 12    c.  Copies of written tests completed by the student.
  2 13    d.  A statement of the number of classroom hours of
  2 14 instruction.
  2 15    e.  A log of completed street or highway driving
  2 16 instruction including the dates when the lessons were
  2 17 conducted, the student's and the teaching parent's name and
  2 18 initials noted next to each entry, notes on driving activities
  2 19 including a list of driving deficiencies and improvements, and
  2 20 the duration of the driving time for each session.  If the
  2 21 department of education is satisfied that the course has been
  2 22 completed in accordance with this section, the department
  2 23 shall certify the course as an approved driver education
  2 24 course.
  2 25    5.  INTERMEDIATE LICENSE.  Any student who successfully
  2 26 completes an approved driver education course as provided in
  2 27 this section, passes a driving field test to be administered
  2 28 by the department, and is otherwise qualified under section
  2 29 321.180B, subsection 2, shall be eligible for an intermediate
  2 30 license pursuant to section 321.180B.  Such a student is not
  2 31 required to file an affidavit with the department regarding
  2 32 completion of street or highway driving with a parent or
  2 33 guardian under section 321.180B, subsection 2, and the hours
  2 34 of driving required under subsection 3 of this section shall
  2 35 substitute for any hours of driving required under section
  3  1 321.180B, subsection 2.
  3  2    6.  FULL LICENSE.  A student must comply with section
  3  3 321.180B, subsection 4, to be eligible for a full driver's
  3  4 license pursuant to section 321.180B.  
  3  5                           EXPLANATION 
  3  6    This bill creates an alternative means for a child between
  3  7 14 and 17 years of age to receive driver education instruction
  3  8 currently offered by public schools.  The bill allows a parent
  3  9 or guardian, who holds a valid Iowa driver's license and is
  3 10 providing competent private instruction to a student, to teach
  3 11 the student driver education.  The classroom instruction
  3 12 requirements for the alternative course of instruction are
  3 13 substantially the same as for an approved course of
  3 14 instruction offered by a public school district or private or
  3 15 commercial driver education school, with additional
  3 16 requirements for 40 hours of street or highway driving
  3 17 including night driving.
  3 18    The teaching parent is required to document substantial
  3 19 compliance with the driver education course requirements and
  3 20 certify the student's satisfactory completion of the course to
  3 21 the department of education.  The current requirement that a
  3 22 person 16 or 17 years of age, applying for an intermediate
  3 23 license, must supply a signed affidavit of accumulated street
  3 24 or highway driving time is waived for a student who completes
  3 25 the course of instruction under the bill.
