  1  1    Section 1.  Section 331.301, subsection 15, paragraph a,
  1  2 Code 2003, is amended to read as follows:
  1  3    a.  A county may adopt and enforce an ordinance requiring
  1  4 the construction of a storm shelter at a manufactured home
  1  5 community or mobile home park which is constructed after July
  1  6 1, 1999.  In lieu of requiring construction of a storm
  1  7 shelter, a county may require a community or park owner to
  1  8 provide a plan for the evacuation of community or park
  1  9 residents to a safe place of shelter in times of severe
  1 10 weather including tornadoes and high winds if the county
  1 11 determines that a safe place of shelter is available within a
  1 12 reasonable distance of the manufactured home community or
  1 13 mobile home park for immediate twenty-four-hour use by
  1 14 community or park residents.  Each evacuation plan prepared
  1 15 pursuant to this subsection shall be filed with, and approved
  1 16 by, the local emergency management agency.  If construction of
  1 17 a storm shelter is required, an the residents of the
  1 18 manufactured home community or mobile home park shall have
  1 19 immediate twenty-four-hour access to the shelter during severe
  1 20 weather.  An ordinance adopted or enforced pursuant to this
  1 21 subsection shall not include any of the following
  1 22 requirements:
  1 23    (1)  That the size of the storm shelter be larger than the
  1 24 equivalent of seven fifteen square feet for each manufactured
  1 25 or mobile home space in the manufactured home community or
  1 26 mobile home park.
  1 27    (2)  That the storm shelter include a restroom if the
  1 28 shelter is used exclusively as a storm shelter.
  1 29    (3)  That the storm shelter exceed the construction
  1 30 specifications approved by a licensed professional engineer
  1 31 and presented by the owner of the manufactured home community
  1 32 or mobile home park local emergency management agency, or the
  1 33 standards recommended by the federal emergency management
  1 34 agency.
  1 35    (4)  That the shelter be located any closer than one
  2  1 thousand three two hundred twenty feet from any manufactured
  2  2 or mobile home in the manufactured home community or mobile
  2  3 home park.
  2  4    Sec. 2.  Section 364.3, subsection 8, paragraph a, Code
  2  5 2003, is amended to read as follows:
  2  6    a.  A city may adopt and enforce an ordinance requiring the
  2  7 construction of a storm shelter at a manufactured home
  2  8 community or mobile home park which is constructed after July
  2  9 1, 1999.  In lieu of requiring construction of a storm
  2 10 shelter, a city may require a community or park owner to

  3  3    (4)  That the shelter be located any closer than one
  3  4 thousand three two hundred twenty feet from any manufactured
  3  5 or mobile home in the community.  However, this restriction
  3  6 shall not prohibit the adoption or enforcement of an ordinance
  3  7 that requires a minimum of one shelter to be located in a
  3  8 manufactured home community or mobile home park.
  3  9    Sec. 3.  Section 364.3, subsection 8, Code 2003, is amended
  3 10 by adding the following new paragraph:
  3 11    NEW PARAGRAPH.  c.  If a city adopts an ordinance pursuant
  3 12 to this subsection which contains standards that are less
  3 13 stringent than the standards contained in an ordinance adopted
  3 14 by the county in which the city lies, the stricter standard
  3 15 shall apply.  
  3 16                           EXPLANATION
  3 17    This bill provides that counties and cities who adopt an
  3 18 ordinance requiring the construction of a storm shelter within
  3 19 a manufactured home community and mobile home park, or
  3 20 requiring an evacuation plan to a shelter outside of the
  3 21 community or park, must ensure immediate 24-hour access to the
  3 22 shelter by residents during severe weather.  The bill
  3 23 increases the allowed requirement of a maximum size of a
  3 24 shelter from seven square feet to 15 square feet for each
  3 25 manufactured or mobile home space within the community or
  3 26 park.  The bill decreases the required maximum distance
  3 27 between a shelter and any manufactured or mobile home within
  3 28 the community or park from 1,320 feet to 1,200 feet.  The bill
  3 29 shifts the approval of the shelter construction specifications
  3 30 from a licensed engineer and the owner of the manufactured
  3 31 home community or mobile home park to a licensed engineer and
  3 32 the local emergency management agency or the standards
  3 33 recommended by the federal emergency management agency.
  3 34    The bill provides that where a city adopts an ordinance
  3 35 requiring the construction of a storm shelter within a
  4  1 manufactured home community and mobile home park, and the
  4  2 ordinance contains standards which are less stringent than
  4  3 those standards adopted by the county in which the city lies,
  4  4 the stricter standard of the county shall apply.
