1 1 Section 1. SUBSTANCE ABUSE APPROPRIATION.
1 2 1. There is appropriated from the fund created by section
1 3 8.41 to the Iowa department of public health for the federal
1 4 fiscal year beginning October 1, 2003, and ending September
1 5 30, 2004, the following amount:
1 6 .................................................. $ 12,078,439
1 7 a. Funds appropriated in this subsection are the
1 8 anticipated funds to be received from the federal government
1 9 for the designated federal fiscal year under 42 U.S.C.,
1 10 chapter 6A, subchapter XVII, which provides for the substance
1 11 abuse prevention and treatment block grant. The department
1 12 shall expend the funds appropriated in this subsection as
1 13 provided in the federal law making the funds available and in
1 14 conformance with chapter 17A.
1 15 b. Of the funds appropriated in this subsection, an amount
1 16 not exceeding 5 percent shall be used by the department for
1 17 administrative expenses.
1 18 c. The department shall expend no less than an amount
1 19 equal to the amount expended for treatment services in the
1 20 state fiscal year beginning July 1, 2002, for pregnant women
1 21 and women with dependent children.
1 22 d. Of the funds appropriated in this subsection, an amount
1 23 not exceeding $24,585 shall be used for audits.
1 24 2. The funds remaining from the appropriation made in
1 25 subsection 1 shall be allocated as follows:
1 26 a. At least 20 percent of the allocation shall be for
1 27 prevention programs.
1 28 b. At least 35 percent of the allocation shall be spent on
1 29 drug treatment and prevention activities.
1 30 c. At least 35 percent of the allocation shall be spent on
1 31 alcohol treatment and prevention activities.
1 32 3. The substance abuse block grant funds received from the
1 33 federal government in excess of the amount of the anticipated
1 34 federal fiscal year 2003-2004 award appropriated in subsection
1 35 1 shall be distributed at least 50 percent to treatment
2 1 programs and 50 percent to prevention programs except that,
2 2 based upon federal guidelines, the total amount of the excess
2 3 awarded to prevention programs shall not exceed $1,000,000.
2 4 4. In implementing the federal substance abuse prevention
2 5 and treatment block grant under 42 U.S.C., chapter 6A,
2 6 subchapter XVII, and any other applicable provisions of the
2 7 federal Public Health Service Act under 42 U.S.C., chapter 6A,
2 8 subchapter III-A, the department shall apply the provisions of
2 9 Pub. L. No. 106-310, } 3305, as codified in 42 U.S.C. } 300x-
2 10 65, relating to services under such federal law being provided
2 11 by religious and other nongovernmental organizations.
2 12 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION.
2 13 1. a. There is appropriated from the fund created by
2 14 section 8.41 to the Iowa department of human services for the
2 15 federal fiscal year beginning October 1, 2003, and ending
2 16 September 30, 2004, the following amount:
2 17 .................................................. $ 3,612,827
2 18 b. Funds appropriated in this subsection are the
2 19 anticipated funds to be received from the federal government
2 20 for the designated federal fiscal year under 42 U.S.C.,
2 21 chapter 6A, subchapter XVII, which provides for the community
2 22 mental health services block grant. The department shall
2 23 expend the funds appropriated in this subsection as provided
2 24 in the federal law making the funds available and in
2 25 conformance with chapter 17A.
2 26 c. The administrator of the division of mental health and
2 27 developmental disabilities of the department of human services
2 28 shall allocate not less than 95 percent of the amount of the
2 29 block grant to eligible community mental health services
2 30 providers for carrying out the plan submitted to and approved
2 31 by the federal substance abuse and mental health services
2 32 administration for the fiscal year involved.
2 33 2. An amount not exceeding 5 percent of the funds
2 34 appropriated in subsection 1 shall be used by the department
2 35 of human services for administrative expenses. From the funds
3 1 set aside by this subsection for administrative expenses, the
3 2 division of mental health and developmental disabilities shall
3 3 pay to the auditor of state an amount sufficient to pay the
3 4 cost of auditing the use and administration of the state's
3 5 portion of the funds appropriated in subsection 1. The
3 6 auditor of state shall bill the division of mental health and
3 7 developmental disabilities for the costs of the audits.
3 8 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS.
3 9 1. There is appropriated from the fund created by section
3 10 8.41 to the Iowa department of public health for the federal
3 11 fiscal year beginning October 1, 2003, and ending September
3 12 30, 2004, the following amount:
3 13 .................................................. $ 7,131,009
3 14 The funds appropriated in this subsection are the funds
3 15 anticipated to be received from the federal government for the
3 16 designated federal fiscal year under 42 U.S.C., chapter 7,
3 17 subchapter V, which provides for the maternal and child health
3 18 services block grant. The department shall expend the funds
3 19 appropriated in this subsection as provided in the federal law
3 20 making the funds available and in conformance with chapter
3 21 17A.
3 22 Of the funds appropriated in this subsection, an amount not
3 23 exceeding $45,700 shall be used for audits.
3 24 Funds appropriated in this subsection shall not be used by
3 25 the university of Iowa hospitals and clinics for indirect
3 26 costs.
3 27 2. An amount not exceeding $150,000 of the funds
3 28 appropriated in subsection 1 to the Iowa department of public
3 29 health shall be used by the Iowa department of public health
3 30 for administrative expenses in addition to the amount to be
3 31 used for audits in subsection 1.
3 32 The departments of public health, human services, and
3 33 education and the university of Iowa's mobile and regional
3 34 child health specialty clinics shall continue to pursue to the
3 35 maximum extent feasible the coordination and integration of
4 1 services to women and children.
4 2 3. a. Sixty-three percent of the remaining funds
4 3 appropriated in subsection 1 shall be allocated to supplement
4 4 appropriations for maternal and child health programs within
4 5 the Iowa department of public health. Of these funds,
4 6 $300,291 shall be set aside for the statewide perinatal care
4 7 program.
4 8 b. Thirty-seven percent of the remaining funds
4 9 appropriated in subsection 1 shall be allocated to the
4 10 university of Iowa hospitals and clinics under the control of
4 11 the state board of regents for mobile and regional child
4 12 health specialty clinics. The university of Iowa hospitals
4 13 and clinics shall not receive an allocation for indirect costs
4 14 from the funds for this program. Priority shall be given to
4 15 establishment and maintenance of a statewide system of mobile
4 16 and regional child health specialty clinics.
4 17 4. The Iowa department of public health shall administer
4 18 the statewide maternal and child health program and the
4 19 crippled children's program by conducting mobile and regional
4 20 child health specialty clinics and conducting other activities
4 21 to improve the health of low-income women and children and to
4 22 promote the welfare of children with actual or potential
4 23 handicapping conditions and chronic illnesses in accordance
4 24 with the requirements of Title V of the federal Social
4 25 Security Act.
4 26 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES
4 27 APPROPRIATIONS.
4 28 1. There is appropriated from the fund created by section
4 29 8.41 to the Iowa department of public health for the federal
4 30 fiscal year beginning October 1, 2003, and ending September
4 31 30, 2004, the following amount:
4 32 .................................................. $ 1,505,162
4 33 Funds appropriated in this subsection are the funds
4 34 anticipated to be received from the federal government for the
4 35 designated federal fiscal year under 42 U.S.C., chapter 6A,
5 1 subchapter XVII, which provides for the preventive health and
5 2 health services block grant. The department shall expend the
5 3 funds appropriated in this subsection as provided in the
5 4 federal law making the funds available and in conformance with
5 5 chapter 17A.
5 6 Of the funds appropriated in this subsection, an amount not
5 7 exceeding $5,522 shall be used for audits.
5 8 2. Of the funds appropriated in subsection 1, the specific
5 9 amount of funds stipulated by the notice of the block grant
5 10 award shall be allocated for services to victims of sex
5 11 offenses and for rape prevention education.
5 12 3. After deducting the funds allocated in subsections 1
5 13 and 2, an amount not exceeding $94,670 of the remaining funds
5 14 appropriated in subsection 1 shall be used by the Iowa
5 15 department of public health for administrative expenses in
5 16 addition to the amount to be used for audits in subsection 1.
5 17 4. After deducting the funds allocated in subsections 1,
5 18 2, and 3, the remaining funds appropriated in subsection 1
5 19 shall be used by the department for healthy people
5 20 2010/healthy Iowans 2010 program objectives, preventive health
5 21 advisory committee, and risk reduction services, including
5 22 nutrition programs, health incentive programs, chronic disease
5 23 services, emergency medical services, monitoring of the
5 24 fluoridation program and start-up fluoridation grants, and
5 25 acquired immune deficiency syndrome services. The moneys
5 26 specified in this subsection shall not be used by the
5 27 university of Iowa hospitals and clinics or by the state
5 28 hygienic laboratory for the funding of indirect costs. Of the
5 29 funds used by the department under this subsection, an amount
5 30 not exceeding $90,000 shall be used for the monitoring of the
5 31 fluoridation program and for start-up fluoridation grants to
5 32 public water systems, and an amount not exceeding $50,000
5 33 shall be used to provide chlamydia testing.
5 34 Sec. 5. DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM
5 35 APPROPRIATION.
6 1 1. There is appropriated from the fund created by section
6 2 8.41 to the office of the governor for the drug policy
6 3 coordinator for the federal fiscal year beginning October 1,
6 4 2003, and ending September 30, 2004, the following amount:
6 5 .................................................. $ 6,731,524
6 6 Funds appropriated in this subsection are the anticipated
6 7 funds to be received from the federal government for the
6 8 designated fiscal year under 42 U.S.C., chapter 46, subchapter
6 9 V, which provides for the drug control and system improvement
6 10 grant program. The drug policy coordinator shall expend the
6 11 funds appropriated in this subsection as provided in the
6 12 federal law making the funds available and in conformance with
6 13 chapter 17A.
6 14 2. An amount not exceeding 10 percent of the funds
6 15 appropriated in subsection 1 shall be used by the drug policy
6 16 coordinator for administrative expenses. From the funds set
6 17 aside by this subsection for administrative expenses, the drug
6 18 policy coordinator shall pay to the auditor of state an amount
6 19 sufficient to pay the cost of auditing the use and
6 20 administration of the state's portion of the funds
6 21 appropriated in subsection 1.
6 22 Sec. 6. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM
6 23 APPROPRIATION.
6 24 1. There is appropriated from the fund created by section
6 25 8.41 to the department of justice for the federal fiscal year
6 26 beginning October 1, 2003, and ending September 30, 2004, the
6 27 following amount:
6 28 .................................................. $ 1,853,100
6 29 Funds appropriated in this subsection are the anticipated
6 30 funds to be received from the federal government for the
6 31 designated fiscal year under 42 U.S.C., chapter 46, subchapter
6 32 XII-H, which provides for grants to combat violent crimes
6 33 against women. The department of justice shall expend the
6 34 funds appropriated in this subsection as provided in the
6 35 federal law making the funds available and in conformance with
7 1 chapter 17A.
7 2 2. An amount not exceeding 5 percent of the funds
7 3 appropriated in subsection 1 shall be used by the department
7 4 of justice for administrative expenses. From the funds set
7 5 aside by this subsection for administrative expenses, the
7 6 department shall pay to the auditor of state an amount
7 7 sufficient to pay the cost of auditing the use and
7 8 administration of the state's portion of the funds
7 9 appropriated in subsection 1.
7 10 Sec. 7. LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION.
7 11 1. There is appropriated from the fund created by section
7 12 8.41 to the office of the governor for the drug policy
7 13 coordinator for the federal fiscal year beginning October 1,
7 14 2003, and ending September 30, 2004, the following amount:
7 15 .................................................. $ 304,748
7 16 Funds appropriated in this subsection are the funds
7 17 anticipated to be received from the federal government for the
7 18 designated federal fiscal year under annual federal
7 19 appropriations which provide for grants to reduce crime and
7 20 improve public safety. The drug policy coordinator shall
7 21 expend the funds appropriated in this subsection as provided
7 22 in the federal law making the funds available and in
7 23 conformance with chapter 17A.
7 24 2. An amount not exceeding 3 percent of the funds
7 25 appropriated in subsection 1 shall be used by the drug policy
7 26 coordinator for administrative expenses. From the funds set
7 27 aside by this subsection for administrative expenses, the drug
7 28 policy coordinator shall pay to the auditor of state an amount
7 29 sufficient to pay the cost of auditing the use and
7 30 administration of the state's portion of the funds
7 31 appropriated in subsection 1.
7 32 Sec. 8. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE
7 33 PRISONERS FORMULA GRANT PROGRAM. There is appropriated from
7 34 the fund created by section 8.41 to the office of the governor
7 35 for the drug policy coordinator for the federal fiscal year
8 1 beginning October 1, 2003, and ending September 30, 2004, the
8 2 following amount:
8 3 .................................................. $ 633,248
8 4 Funds appropriated in this section are the funds
8 5 anticipated to be received from the federal government for the
8 6 designated federal fiscal year under 42 U.S.C., chapter 136,
8 7 which provides grants for substance abuse treatment programs
8 8 in state and local correctional facilities. The drug policy
8 9 coordinator shall expend the funds appropriated in this
8 10 section as provided in the federal law making the funds
8 11 available and in conformance with chapter 17A.
8 12 Sec. 9. COMMUNITY SERVICES APPROPRIATIONS.
8 13 1. a. There is appropriated from the fund created by
8 14 section 8.41 to the division of community action agencies of
8 15 the department of human rights for the federal fiscal year
8 16 beginning October 1, 2003, and ending September 30, 2004, the
8 17 following amount:
8 18 .................................................. $ 6,956,142
8 19 Funds appropriated in this subsection are the funds
8 20 anticipated to be received from the federal government for the
8 21 designated federal fiscal year under 42 U.S.C., chapter 106,
8 22 which provides for the community services block grant. The
8 23 division of community action agencies of the department of
8 24 human rights shall expend the funds appropriated in this
8 25 subsection as provided in the federal law making the funds
8 26 available and in conformance with chapter 17A.
8 27 b. The administrator of the division of community action
8 28 agencies of the department of human rights shall allocate not
8 29 less than 96 percent of the amount of the block grant to
8 30 eligible community action agencies for programs benefiting
8 31 low-income persons. Each eligible agency shall receive a
8 32 minimum allocation of not less than $100,000. The minimum
8 33 allocation shall be achieved by redistributing increased funds
8 34 from agencies experiencing a greater share of available funds.
8 35 The funds shall be distributed on the basis of the poverty-
9 1 level population in the area represented by the community
9 2 action areas compared to the size of the poverty-level
9 3 population in the state.
9 4 2. An amount not exceeding 4 percent of the funds
9 5 appropriated in subsection 1 shall be used by the division of
9 6 community action agencies of the department of human rights
9 7 for administrative expenses. From the funds set aside by this
9 8 subsection for administrative expenses, the division of
9 9 community action agencies of the department of human rights
9 10 shall pay to the auditor of state an amount sufficient to pay
9 11 the cost of auditing the use and administration of the state's
9 12 portion of the funds appropriated in subsection 1. The
9 13 auditor of state shall bill the division of community action
9 14 agencies for the costs of the audits.
9 15 Sec. 10. COMMUNITY DEVELOPMENT APPROPRIATIONS.
9 16 1. There is appropriated from the fund created by section
9 17 8.41 to the Iowa department of economic development for the
9 18 federal fiscal year beginning October 1, 2003, and ending
9 19 September 30, 2004, the following amount:
9 20 .................................................. $ 32,600,000
9 21 Funds appropriated in this subsection are the funds
9 22 anticipated to be received from the federal government for the
9 23 designated federal fiscal year under 42 U.S.C., chapter 69,
9 24 which provides for community development block grants. The
9 25 Iowa department of economic development shall expend the funds
9 26 appropriated in this subsection as provided in the federal law
9 27 making the funds available and in conformance with chapter
9 28 17A.
9 29 2. An amount not exceeding $1,504,000 for the federal
9 30 fiscal year beginning October 1, 2003, shall be used by the
9 31 Iowa department of economic development for administrative
9 32 expenses for the community development block grant. The total
9 33 amount used for administrative expenses includes $752,000 for
9 34 the federal fiscal year beginning October 1, 2003, of funds
9 35 appropriated in subsection 1 and a matching contribution from
10 1 the state equal to $752,000 from the appropriation of state
10 2 funds for the community development block grant and state
10 3 appropriations for related activities of the Iowa department
10 4 of economic development. From the funds set aside for
10 5 administrative expenses by this subsection, the Iowa
10 6 department of economic development shall pay to the auditor of
10 7 state an amount sufficient to pay the cost of auditing the use
10 8 and administration of the state's portion of the funds
10 9 appropriated in subsection 1. The auditor of state shall bill
10 10 the department for the costs of the audit.
10 11 Sec. 11. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS.
10 12 1. There is appropriated from the fund created by section
10 13 8.41 to the division of community action agencies of the
10 14 department of human rights for the federal fiscal year
10 15 beginning October 1, 2003, and ending September 30, 2004, the
10 16 following amount:
10 17 .................................................. $ 31,116,126
10 18 The funds appropriated in this subsection are the funds
10 19 anticipated to be received from the federal government for the
10 20 designated federal fiscal year under 42 U.S.C., chapter 94,
10 21 subchapter II, which provides for the low-income home energy
10 22 assistance block grants. The division of community action
10 23 agencies of the department of human rights shall expend the
10 24 funds appropriated in this subsection as provided in the
10 25 federal law making the funds available and in conformance with
10 26 chapter 17A.
10 27 2. Up to 15 percent of the amount appropriated in this
10 28 section that is actually received shall be used for
10 29 residential weatherization or other related home repairs for
10 30 low-income households. Of this allocation amount, not more
10 31 than 10 percent may be used for administrative expenses. In
10 32 order to receive low-income home energy assistance program
10 33 funding, the head of an eligible household must be willing to
10 34 allow residential weatherization or other related home
10 35 repairs. However, if the eligible household is located in
11 1 rental property, the unwillingness of the property owner to
11 2 allow residential weatherization or other related home repairs
11 3 shall not prevent the eligible household from receiving low-
11 4 income home energy assistance program funding.
11 5 3. After subtracting the allocation in subsection 2, up to
11 6 $2,645,721 is allocated for administrative expenses of the
11 7 low-income home energy assistance program of which $290,000 is
11 8 allocated for administrative expenses of the division. The
11 9 costs of auditing the use and administration of the portion of
11 10 the appropriation in this section that is retained by the
11 11 state shall be paid from the amount allocated in this
11 12 subsection to the division. The auditor of state shall bill
11 13 the division for the audit costs.
11 14 4. The remainder of the appropriation in this section
11 15 following the allocations made in subsections 2 and 3, shall
11 16 be used to help eligible households as defined in 42 U.S.C.,
11 17 chapter 94, subchapter II, to meet home energy costs.
11 18 5. Not more than 10 percent of the amount appropriated in
11 19 this section that is actually received may be carried forward
11 20 for use in the succeeding federal fiscal year.
11 21 6. Expenditures for assessment and resolution of energy
11 22 problems shall be limited to 5 percent of the amount
11 23 appropriated in this section that is actually received.
11 24 Sec. 12. SOCIAL SERVICES APPROPRIATIONS.
11 25 1. There is appropriated from the fund created by section
11 26 8.41 to the department of human services for the federal
11 27 fiscal year beginning October 1, 2003, and ending September
11 28 30, 2004, the following amount:
11 29 .................................................. $ 17,578,494
11 30 Funds appropriated in this subsection are the funds
11 31 anticipated to be received from the federal government for the
11 32 designated federal fiscal year under 42 U.S.C., chapter 7,
11 33 subchapter XX, which provides for the social services block
11 34 grant. The department of human services shall expend the
11 35 funds appropriated in this subsection as provided in the
12 1 federal law making the funds available and in conformance with
12 2 chapter 17A.
12 3 2. Not more than $1,117,774 of the funds appropriated in
12 4 subsection 1 shall be used by the department of human services
12 5 for general administration. From the funds set aside in this
12 6 subsection for general administration, the department of human
12 7 services shall pay to the auditor of state an amount
12 8 sufficient to pay the cost of auditing the use and
12 9 administration of the state's portion of the funds
12 10 appropriated in subsection 1.
12 11 3. In addition to the allocation for general
12 12 administration in subsection 2, the remaining funds
12 13 appropriated in subsection 1 shall be allocated in the
12 14 following amounts to supplement appropriations for the federal
12 15 fiscal year beginning October 1, 2003, for the following
12 16 programs within the department of human services:

12 29 Sec. 13. SOCIAL SERVICES BLOCK GRANT PLAN. The department
12 30 of human services during each state fiscal year shall develop
12 31 a plan for the use of federal social services block grant
12 32 funds for the subsequent state fiscal year.
12 33 The proposed plan shall include all programs and services
12 34 at the state level which the department proposes to fund with
12 35 federal social services block grant funds, and shall identify
13 1 state and other funds which the department proposes to use to
13 2 fund the state programs and services.
13 3 The proposed plan shall also include all local programs and
13 4 services which are eligible to be funded with federal social
13 5 services block grant funds, the total amount of federal social
13 6 services block grant funds available for the local programs
13 7 and services, and the manner of distribution of the federal
13 8 social services block grant funds to the counties. The
13 9 proposed plan shall identify state and local funds which will
13 10 be used to fund the local programs and services.
13 11 The proposed plan shall be submitted with the department's
13 12 budget requests to the governor and the general assembly.
13 13 Sec. 14. PROJECTS FOR ASSISTANCE IN TRANSITION FROM
13 14 HOMELESSNESS.
13 15 1. Upon receipt of the minimum formula grant from the
13 16 federal alcohol, drug abuse, and mental health administration
13 17 to provide mental health services for the homeless, for the
13 18 federal fiscal year beginning October 1, 2003, and ending
13 19 September 30, 2004, the department of human services shall
13 20 assure that a project which receives funds under the formula
13 21 grant from either the federal or local match share of 25
13 22 percent in order to provide outreach services to persons who
13 23 have chronic mental illness and are homeless or who are
13 24 subject to a significant probability of becoming homeless
13 25 shall do all of the following:
13 26 a. Provide community mental health services, diagnostic
13 27 services, crisis intervention services, and habilitation and
13 28 rehabilitation services.
13 29 b. Refer clients to medical facilities for necessary
13 30 hospital services, and to entities that provide primary health
13 31 services and substance abuse services.
13 32 c. Provide appropriate training to persons who provide
13 33 services to persons targeted by the grant.
13 34 d. Provide case management to homeless persons.
13 35 e. Provide supportive and supervisory services to certain
14 1 homeless persons living in residential settings which are not
14 2 otherwise supported.
14 3 2. Projects may expend funds for housing services
14 4 including minor renovation, expansion and repair of housing,
14 5 security deposits, planning of housing, technical assistance
14 6 in applying for housing, improving the coordination of housing
14 7 services, the costs associated with matching eligible homeless
14 8 individuals with appropriate housing, and one-time rental
14 9 payments to prevent eviction.
14 10 3. If the department has data indicating that a geographic
14 11 area has a substantial number of persons with mental illness
14 12 who are homeless and are not being served by an existing
14 13 grantee for that area under the formula grant and the existing
14 14 grantee has expressed a desire to no longer provide services
14 15 or the grantee's contract was terminated by the department for
14 16 nonperformance, the department shall issue a request for
14 17 proposals to replace the grantee. Otherwise, the department
14 18 shall maximize available funding by continuing to contract to
14 19 the extent possible with those persons who are grantees as of
14 20 the effective date of this subsection. The department shall
14 21 issue a request for proposals if additional funding becomes
14 22 available for expansion to persons who are not being served
14 23 and it is not possible to utilize existing grantees.
14 24 Sec. 15. CHILD CARE AND DEVELOPMENT APPROPRIATION. There
14 25 is appropriated from the fund created by section 8.41 to the
14 26 department of human services for the federal fiscal year
14 27 beginning October 1, 2003, and ending September 30, 2004, the
14 28 following amount:
14 29 .................................................. $ 42,089,767
14 30 Funds appropriated in this section are the funds
14 31 anticipated to be received from the federal government under
14 32 42 U.S.C., chapter 105, subchapter II-B, which provides for
14 33 the child care and development block grant. The department
14 34 shall expend the funds appropriated in this section as
14 35 provided in the federal law making the funds available and in
15 1 conformance with chapter 17A.
15 2 Sec. 16. PROCEDURE FOR REDUCED FEDERAL FUNDS.
15 3 1. If the funds received from the federal government for
15 4 the block grants specified in this Act are less than the
15 5 amounts appropriated, the funds actually received shall be
15 6 prorated by the governor for the various programs, other than
15 7 for the services to victims of sex offenses and for rape
15 8 prevention education under section 4, subsection 2, of this
15 9 Act, for which each block grant is available according to the
15 10 percentages that each program is to receive as specified in
15 11 this Act. However, if the governor determines that the funds
15 12 allocated by the percentages will not be sufficient to effect
15 13 the purposes of a particular program, or if the appropriation
15 14 is not allocated by percentage, the governor may allocate the
15 15 funds in a manner which will effect to the greatest extent
15 16 possible the purposes of the various programs for which the
15 17 block grants are available.
15 18 2. Before the governor implements the actions provided for
15 19 in subsection 1, the following procedures shall be taken:
15 20 a. The chairpersons and ranking members of the senate and
15 21 house standing committees on appropriations, the appropriate
15 22 chairpersons and ranking members of subcommittees of those
15 23 committees, and the director of the legislative service bureau
15 24 and the director of the legislative fiscal bureau or the
15 25 director of legislative services agency succeeding the two
15 26 bureaus if such agency is established by law, shall be
15 27 notified of the proposed action.
15 28 b. The notice shall include the proposed allocations, and
15 29 information on the reasons why particular percentages or
15 30 amounts of funds are allocated to the individual programs, the
15 31 departments and programs affected, and other information
15 32 deemed useful. Chairpersons notified shall be allowed at
15 33 least two weeks to review and comment on the proposed action
15 34 before the action is taken.
15 35 3. If the amount of moneys received from the federal
16 1 government for a specific grant number specified in this Act
16 2 is less than the amount appropriated, the amount appropriated
16 3 shall be reduced accordingly. An annual report listing any
16 4 such appropriation reduction shall be submitted to the fiscal
16 5 committee of the legislative council.
16 6 Sec. 17. PROCEDURE FOR INCREASED FEDERAL FUNDS.
16 7 1. If funds received from the federal government in the
16 8 form of block grants exceed the amounts appropriated in
16 9 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess
16 10 shall be prorated to the appropriate programs according to the
16 11 percentages specified in those sections, except additional
16 12 funds shall not be prorated for administrative expenses.
16 13 2. If actual funds received from the federal government
16 14 from block grants exceed the amount appropriated in section 11
16 15 of this Act for the low-income home energy assistance program,
16 16 not more than 15 percent of the excess may be allocated to the
16 17 low-income residential weatherization program and not more
16 18 than 5 percent of the excess may be used for administrative
16 19 costs.
16 20 3. If funds received from the federal government from
16 21 community services block grants exceed the amount appropriated
16 22 in section 9 of this Act, 100 percent of the excess is
16 23 allocated to the community services block grant program.
16 24 4. If the amount of moneys received from the federal
16 25 government for a specific grant number specified in this Act
16 26 exceeds the amount appropriated, the excess amount is
16 27 appropriated for the purpose designated in the specific
16 28 grant's appropriation. An annual report listing any such
16 29 excess appropriations shall be submitted to the fiscal
16 30 committee of the legislative council.
16 31 Sec. 18. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL
16 32 FUNDS. If other federal grants, receipts, and funds and other
16 33 nonstate grants, receipts, and funds become available or are
16 34 awarded which are not available or awarded during the period
16 35 in which the general assembly is in session, but which require
17 1 expenditure by the applicable department or agency prior to
17 2 March 15 of the fiscal year beginning July 1, 2003, and ending
17 3 June 30, 2004, these grants, receipts, and funds are
17 4 appropriated to the extent necessary, provided that the fiscal
17 5 committee of the legislative council is notified within thirty
17 6 days of receipt of the grants, receipts, or funds and the
17 7 fiscal committee of the legislative council has an opportunity
17 8 to comment on the expenditure of the grants, receipts, or
17 9 funds.
17 10 Sec. 19. DEPARTMENT OF ADMINISTRATIVE SERVICES. Federal
17 11 grants, receipts, and funds and other nonstate grants,
17 12 receipts, and funds, available in whole or in part of the
17 13 fiscal year beginning July 1, 2003, and ending June 30, 2004,

42 31 Sec. 58. COMMISSION OF VETERANS AFFAIRS. Federal grants,
42 32 receipts, and funds and other nonstate grants, receipts, and
42 33 funds, available in whole or in part for the fiscal year
42 34 beginning July 1, 2003, and ending June 30, 2004, are
42 35 appropriated to the commission of veterans affairs for the
43 1 purposes set forth in the grants, receipts, or conditions
43 2 accompanying the receipt of the funds, unless otherwise
43 3 provided by law.
43 4 The following amounts are appropriated to the commission of
43 5 veterans affairs for the fiscal year beginning July 1, 2003,

44 31 EXPLANATION
44 32 This bill appropriates for the 2003-2004 federal fiscal
44 33 year which begins October 1, 2003, block grants available from
44 34 the federal government and provides procedures for increasing
44 35 or decreasing the appropriations if the block grants are
45 1 increased or decreased. General appropriations are made for
45 2 the 2003-2004 state fiscal year which begins July 1, 2003, of
45 3 all other nonstate grants, receipts, and funds available to
45 4 this state.
