  1  1    Section 1.  Section 453A.13, subsection 3, Code 2003, is
  1  2 amended to read as follows:
  1  3    3.  FEES – EXPIRATION.  All permits provided for in this
  1  4 division shall expire on June 30 of each year.  A permit shall
  1  5 not be granted or issued until the applicant has paid for the
  1  6 period ending June 30 next, to the department or the city or
  1  7 county granting the permit, the fees provided for in this
  1  8 division plus an application fee, if charged by the issuing
  1  9 authority, of up to twenty-five dollars.  The annual state
  1 10 permit fee for a distributor, cigarette vendor, and wholesaler
  1 11 is one two hundred dollars when the permit is granted during
  1 12 the months of July, August, or September.  However, whenever a
  1 13 state permit holder operates more than one place of business,
  1 14 a duplicate state permit shall be issued for each additional
  1 15 place of business on payment of five ten dollars for each
  1 16 duplicate state permit, but refunds as provided in this
  1 17 division do not apply to any duplicate permit issued.
  1 18    The fee for retail permits is as follows when the permit is
  1 19 granted during the months of July, August, or September:
  1 20    a.  In places outside any city, fifty one hundred dollars.
  1 21    b.  In cities of less than fifteen thousand population,
  1 22 seventy-five one hundred fifty dollars.
  1 23    c.  In cities of fifteen thousand or more population, one
  1 24 two hundred dollars.
  1 25    If any permit is granted during the months of October,
  1 26 November, or December, the fee shall be three-fourths of the
  1 27 above maximum schedule; if granted during the months of
  1 28 January, February, or March, one-half of the maximum schedule,
  1 29 and if granted during the months of April, May, or June, one-
  1 30 fourth of the maximum schedule.  
  1 31                           EXPLANATION 
  1 32    This bill relates to the fees assessed related to cigarette
  1 33 distributors, vendors, wholesalers, and retailers.
  1 34    The bill provides that a permit is not to be granted until
  1 35 the permit fee, plus an application fee, if charged by the
  2  1 issuing authority of up to $25, is paid.  The bill increases
  2  2 the annual state permit fee for a permit that is issued in
  2  3 July, August, or September for a distributor, cigarette
  2  4 vendor, and wholesaler from $100 to $200.  Permits expire on
  2  5 June 30 of the following year.  The bill increases the cost of
  2  6 a duplicate state permit from $5 to $10.
  2  7    The bill increases retail permit fees that are granted in
  2  8 the months of July, August, or September from $50 to $100 for
  2  9 places outside any city; from $75 to $150 for cities of less
  2 10 than 15,000 population; and from $100 to $200 for cities of
  2 11 15,000 or more.
