PAG LIN 1 1 Section 1. NEW SECTION. 135.39A ENVIRONMENTAL HEALTH 1 2 PRACTITIONERS VOLUNTARY CERTIFICATION. 1 3 The department shall develop guidelines to be used to 1 4 establish and administer a voluntary certification program for 1 5 environmental health practitioners. For the purposes of this 1 6 section, "environmental health practitioner" means an 1 7 individual employed or engaged at the state or local level in 1 8 a capacity that involves the monitoring, identification, or 1 9 correction of environmental conditions or hazards which impact 1 10 the health and well-being of the citizens of this state. 1 11 1. The department shall establish a two-year advisory 1 12 committee to develop criteria and formulate guidelines for 1 13 implementation of the program. The committee shall consist, 1 14 at a minimum, of three representatives of the department, two 1 15 representatives from the Iowa environmental health 1 16 association, and one representative from the department of 1 17 inspections and appeals, the department of natural resources, 1 18 the Iowa on-site waste water association, the Iowa water well 1 19 association, and the Iowa public health association, 1 20 respectively. The director of the division of health 1 21 protection and environmental health of the Iowa department of 1 22 public health shall serve as chairperson of the advisory 1 23 committee and shall, in consultation with the directors of the 1 24 other departments and associations with representation on the 1 25 committee, select committee members. All committee members 1 26 shall have been awarded at least a bachelor's degree in an 1 27 environmental health-related or public health-related field 1 28 and possess a minimum of three years' experience in such a 1 29 field. 1 30 2. The advisory committee shall determine criteria for 1 31 certification of environmental health practitioners which 1 32 address educational and experience requirements, core 1 33 knowledge competencies, and other requirements for 1 34 certification. The criteria shall be submitted to the 1 35 director for final approval. The criteria may be incorporated 2 1 by a city or county board of health into employment criteria 2 2 for individuals entering the field of environmental health. 2 3 The department shall adopt rules pursuant to chapter 17A and 2 4 establish and collect all fees necessary to administer the 2 5 program. 2 6 Sec. 2. Section 139A.8, subsection 1, Code 2003, is 2 7 amended to read as follows: 2 8 1. A parent or legal guardian shall assure that the 2 9 person's minor children residing in the state are adequately 2 10 immunized against diphtheria, pertussis, tetanus, 2 11 poliomyelitis, rubeola,andrubella, and varicella according 2 12 to recommendations provided by the department subject to the 2 13 provisions of subsections 3 and 4. 2 14 Sec. 3. Section 139A.8, subsection 2, paragraph a, Code 2 15 2003, is amended to read as follows: 2 16 a. A person shall not be enrolled in any licensed child 2 17 care center or elementary or secondary school in Iowa without 2 18 evidence of adequate immunizations against diphtheria, 2 19 pertussis, tetanus, poliomyelitis, rubeola,andrubella, and 2 20 varicella. 2 21 Sec. 4. Section 139A.8, subsection 4, paragraph a, Code 2 22 2003, is amended to read as follows: 2 23 a. The applicant, or if the applicant is a minor, the 2 24 applicant's parent or legal guardian, submits to the admitting 2 25 official a statement signed by a physician, nurse 2 26 practitioner, or physician assistant who is licensed by the 2 27stateboard of medical examiners, board of nursing, or board 2 28 of physician assistant examiners that, in the physician's2 29opinion,the immunizations required would be injurious to the 2 30 health and well-being of the applicant or any member of the 2 31 applicant's family. 2 32 Sec. 5. Section 152.1, subsection 5, paragraph b, Code 2 33 2003, is amended by striking the paragraph and inserting in 2 34 lieu thereof the following: 2 35 b. The performance of nursing services by an unlicensed 3 1 student enrolled in a nursing education program if performance 3 2 is part of the course of study. Individuals who have been 3 3 licensed as registered nurses or licensed practical or 3 4 vocational nurses in any state or jurisdiction of the United 3 5 States are not subject to this exemption. 3 6 Sec. 6. Section 152.1, subsection 5, paragraph c, Code 3 7 2003, is amended to read as follows: 3 8 c. The performance of services byemployedunlicensed 3 9 workers employed in offices, hospitals, or health care 3 10 facilities, as defined in section 135C.1, under the 3 11 supervision of a physician or a nurse licensed under this 3 12 chapter, or employed in the office of a psychologist, 3 13 podiatric physician, optometrist, chiropractor, speech 3 14 pathologist, audiologist, or physical therapist licensed to 3 15 practice in this state, and when acting while within the scope 3 16 of the employer's license. 3 17 Sec. 7. Section 155A.27, subsection 1, Code 2003, is 3 18 amended by adding the following new paragraph: 3 19 NEW PARAGRAPH. g. The indication or reason for 3 20 prescribing the drug. 3 21 Sec. 8. Section 272C.3, subsection 1, paragraph k, Code 3 22 2003, is amended to read as follows: 3 23 k. Establish a licensee review committee for the purpose 3 24 of evaluating and monitoring licensees whoself-report3 25physical or mental impairments to the boardare impaired as a 3 26 result of alcohol or drug abuse, dependency, or addiction, or 3 27 by any mental or physical disorder or disability, and who 3 28 self-report the impairment to the committee, or who are 3 29 referred by the board to the committee. The board shall adopt 3 30 rules for the establishment and administration of the 3 31 committee, including but not limited to establishment of the 3 32 criteria for eligibility for referral to the committee and the 3 33 grounds for disciplinary action for noncompliance with 3 34 committee decisions. Information in the possession of the 3 35 board or the licensee review committee, under this paragraph, 4 1 shall be subject to the confidentiality requirements of 4 2 section 272C.6. Referral of a licensee by the board to a 4 3 licensee review committee shall not relieve the board of any 4 4 duties of the board and shall not divest the board of any 4 5 authority or jurisdiction otherwise provided. A licensee who 4 6 violates section 272C.10 or the rules of the board while under 4 7 review by the licensee review committee shall be referred to 4 8 the board for appropriate action. 4 9 EXPLANATION 4 10 This bill provides for several changes relating to programs 4 11 under the purview of the Iowa department of public health. 4 12 The bill provides that the department of public health 4 13 shall establish and administer a voluntary certification 4 14 program for environmental health practitioners. The bill 4 15 defines an "environmental health practitioner" as an 4 16 individual employed or engaged at the state or local level in 4 17 a capacity that involves the monitoring, identification, or 4 18 correction of environmental conditions or hazards which impact 4 19 the health and well-being of the citizens of this state. The 4 20 bill provides that a two-year advisory committee shall be 4 21 established to develop criteria and formulate guidelines for 4 22 implementation of the program. The bill specifies 4 23 representatives from various departments and associations for 4 24 membership on the committee, and provides that the director of 4 25 the division of health protection and environmental health of 4 26 the department of public health shall serve as committee 4 27 chairperson. The bill provides that criteria developed by the 4 28 committee shall address educational and experience 4 29 requirements, core knowledge competencies, and requirements 4 30 for certification, and shall be submitted to the director of 4 31 the department for final approval. 4 32 The bill provides for the addition of varicella 4 33 (chickenpox) to the list of required childhood immunizations, 4 34 and adds nurse practitioners and physician assistants as 4 35 health professionals authorized to sign immunization medical 5 1 waivers. 5 2 The bill modifies exemption provisions relating to 5 3 activities constituting the practice of nursing, to make clear 5 4 that the performance of nursing services by students who are 5 5 licensed as registered nurses or practical or vocational 5 6 nurses in any United States jurisdiction will not fall within 5 7 the exemption and will be subject to the jurisdiction of the 5 8 board. 5 9 The bill provides that a prescription drug order is 5 10 required to contain a statement indicating the reason for 5 11 prescribing the drug. 5 12 The bill provides that licensee review committees 5 13 established for the purpose of evaluating and monitoring 5 14 licensees who self-report, or are referred by the board for, 5 15 an impairment relating to alcohol or drug abuse, dependency, 5 16 or addiction, or any mental or physical disorder or 5 17 disability. 5 18 LSB 1166DP 80 5 19 rn/sh/8.1
