  1  1    Section 1.  Section 124.204, subsection 3, paragraph u,
  1  2 Code 2003, is amended by striking the paragraph and inserting
  1  3 in lieu thereof the following:
  1  4    u.  Pholcodine.
  1  5    Sec. 2.  Section 124.204, subsection 6, paragraph g, Code
  1  6 2003, is amended to read as follows:
  1  7    g.  Methcathinone, its salts, optical isomers, and salts of
  1  8 optical isomers.  Some other names:  2-(methylamino)-
  1  9 propiophenone; alpha-(methylamino)propiophenone; 2-
  1 10 (methylamino)-1-phenylpropan-1-one; alpha-N-
  1 11 methylaminopropiophenone; monomethylpropion; ephedrone; N-
  1 12 methylcathinone; methylcathinone; AL-464; AL-422; AL-463; and
  1 13 UR1432.
  1 14    Sec. 3.  Section 124.204, subsection 9, paragraph a, Code
  1 15 2003, is amended to read as follows:
  1 16    a.  N-[1-benzyl-4-piperidyl]-N-phenylpropanamide
  1 17 (denzylfentanyl) (benzylfentanyl), its optical isomers, salts
  1 18 and salts of isomers.
  1 19    Sec. 4.  Section 124.206, subsection 2, paragraph d,
  1 20 unnumbered paragraph 1, Code 2003, is amended to read as
  1 21 follows:
  1 22    Coca leaves and any salt, compound, derivative or
  1 23 preparation of coca leaves.  Decocainized coca leaves or
  1 24 extractions which do not contain cocaine or ecgonine are
  1 25 excluded from this paragraph.  The following substances and
  1 26 their salts, isomers, derivatives, and salts of isomers and
  1 27 derivatives, if salts, isomers, derivatives, or salts of
  1 28 isomers and derivatives exist under the specific chemical
  1 29 designation, are included in this paragraph:
  1 30    Sec. 5.  Section 124.206, subsection 4, paragraph a, Code
  1 31 2003, is amended to read as follows:
  1 32    a.  Amphetamine, its salts, optical isomers, and salts of
  1 33 its optical isomers.
  1 34    Sec. 6.  Section 124.208, subsection 5, Code 2003, is
  1 35 amended by striking the subsection and inserting in lieu
  2  1 thereof the following:
  2  2    5.  NARCOTIC DRUGS.  Unless specifically excepted or unless
  2  3 listed in another schedule:
  2  4    a. Any material, compound, mixture, or preparation
  2  5 containing any of the following narcotic drugs, or their salts
  2  6 calculated as the free anhydrous base or alkaloid, in limited
  2  7 quantities as set forth below:
  2  8    (1)  Not more than one point eight grams of codeine per one
  2  9 hundred milliliters or not more than ninety milligrams per
  2 10 dosage unit, with an equal or greater quantity of an
  2 11 isoquinoline alkaloid of opium.
  2 12    (2)  Not more than one point eight grams of codeine per one
  2 13 hundred milliliters or not more than ninety milligrams per
  2 14 dosage unit, with one or more active, nonnarcotic ingredients
  2 15 in recognized therapeutic amounts.
  2 16    (3)  Not more than three hundred milligrams of
  2 17 dihydrocodeinone (another name:  hydrocodone) per one hundred
  2 18 milliliters or not more than fifteen milligrams per dosage
  2 19 unit, with a fourfold or greater quantity of an isoquinoline
  2 20 alkaloid of opium.
  2 21    (4)  Not more than three hundred milligrams of
  2 22 dihydrocodeinone (another name:  hydrocodone) per one hundred
  2 23 milliliters or not more than fifteen milligrams per dosage
  2 24 unit, with one or more active, nonnarcotic ingredients in
  2 25 recognized therapeutic amounts.
  2 26    (5)  Not more than one point eight grams of dihydrocodeine
  2 27 (another name:  hydrocodone) per one hundred milliliters or
  2 28 not more than ninety milligrams per dosage unit, with one or
  2 29 more active, nonnarcotic ingredients in recognized therapeutic
  2 30 amounts.
  2 31    (6)  Not more than three hundred milligrams of
  2 32 ethylmorphine per one hundred milliliters or not more than
  2 33 fifteen milligrams per dosage unit, with one or more active,
  2 34 nonnarcotic ingredients in recognized therapeutic amounts.
  2 35    (7)  Not more than five hundred milligrams of opium per one
  3  1 hundred milliliters or per one hundred grams or not more than
  3  2 twenty-five milligrams per dosage unit, with one or more
  3  3 active, nonnarcotic ingredients in recognized therapeutic
  3  4 amounts.
  3  5    (8)  Not more than fifty milligrams of morphine per one
  3  6 hundred milliliters or per one hundred grams, with one or more
  3  7 active, nonnarcotic ingredients in recognized therapeutic
  3  8 amounts.
  3  9    b.  Any material, compound, mixture, or preparation
  3 10 containing the narcotic drug buprenorphine, or its salts.
  3 11    Sec. 7.  Section 124.208, subsection 6, unnumbered
  3 12 paragraph 1, Code 2003. is amended to read as follows:
  3 13    Anabolic steroids, except any Any product containing an
  3 14 anabolic steroid which product is expressly intended for
  3 15 administration through implants to cattle or other nonhuman
  3 16 species is excluded from all schedules, unless such steroid is
  3 17 prescribed, dispensed, or distributed for human use.  Anabolic
  3 18 steroids include Unless specifically excepted or unless listed
  3 19 in another schedule, any material, compound, mixture, or
  3 20 preparation containing any quantity of the following
  3 21 substances, including its salts, isomers, and salts of isomers
  3 22 whenever the existence of such salts of isomers is possible
  3 23 within the specific chemical designation, and including any
  3 24 salt, ester, or isomer of the following drugs or substances if
  3 25 that salt, ester, or isomer promotes muscle growth:
  3 26    Sec. 8.  Section 124.212, subsection 3, Code 2003, is
  3 27 amended by striking the subsection.
  3 28    Sec. 9.  Section 124.304, subsection 1, Code 2003, is
  3 29 amended to read as follows:
  3 30    1.  A The board may suspend, revoke, or restrict a
  3 31 registration under section 124.303 to manufacture, distribute,
  3 32 or dispense a controlled substance may be suspended or revoked
  3 33 by the board upon a finding that any of the following apply to
  3 34 the registrant:
  3 35    a.  Has The registrant has furnished false or fraudulent
  4  1 material information in any application filed under this
  4  2 chapter;.
  4  3    b.  Has The registrant has had the registrant's federal
  4  4 registration suspended or revoked to manufacture, distribute,
  4  5 or dispense controlled substances suspended, revoked, or
  4  6 restricted; or.
  4  7    c.  Has The registrant has been convicted of a public
  4  8 offense under any state or federal law relating to any
  4  9 controlled substance.  For the purpose of this section only, a
  4 10 conviction shall include a plea of guilty, a forfeiture of
  4 11 bail or collateral deposited to secure a defendant's
  4 12 appearance in court which forfeiture has not been vacated, or
  4 13 a finding of guilt in a criminal action even though the entry
  4 14 of the judgment or sentence has been withheld and the
  4 15 individual placed on probation.
  4 16    d.  Has The registrant has committed such acts as would
  4 17 render the registrant's registration under section 124.303
  4 18 inconsistent with the public interest as determined under that
  4 19 section.
  4 20    e.  If the registrant is a licensed health care
  4 21 professional, the registrant has had the registrant's
  4 22 professional license revoked or suspended or has been
  4 23 otherwise disciplined in a way that restricts the registrant's
  4 24 authority to handle or prescribe controlled substances.
  4 25    Sec. 10.  Section 124B.2, subsection 1, Code 2003, is
  4 26 amended by adding the following new paragraphs:
  4 27    NEW PARAGRAPH.  x.  Red phosphorus.
  4 28    NEW PARAGRAPH.  y.  White phosphorus (another name: yellow
  4 29 phosphorus).
  4 30    NEW PARAGRAPH.  z.  Hypophosphorous acid and its salts
  4 31 (including ammonium hypophosphite, calcium hypophosphite, iron
  4 32 hypophosphite, potassium hypophosphite, manganese
  4 33 hypophosphite, magnesium hypophosphite, and sodium
  4 34 hypophosphite).  
  4 35                           EXPLANATION
  5  1    This bill provides for several technical changes to Code
  5  2 chapter 124 to reflect recent amendments to the federal
  5  3 Uniform Controlled Substances Act.  The bill also provides for
  5  4 changes to Code chapter 124B to correspond to recent precursor
  5  5 chemical federal amendments.  The bill additionally provides
  5  6 for the suspension, revocation, or restriction of a
  5  7 registrant's authority to handle or prescribe controlled
  5  8 substances in Iowa if the registrant is a licensed health care
  5  9 professional and if the registrant has been the subject of
  5 10 disciplinary action by the health professional licensing board
  5 11 applicable to the registrant.
