  1  1    Section 1.  Section 99B.9, subsection 1, unnumbered
  1  2 paragraph 1, Code 2003, is amended to read as follows:
  1  3    Except as otherwise permitted by section 99B.3, 99B.5,
  1  4 99B.6, 99B.7, 99B.8, or 99B.11, or 99B.12A, it is unlawful to
  1  5 permit gambling on any premises owned, leased, rented, or
  1  6 otherwise occupied by a person other than a government,
  1  7 governmental agency or subdivision, unless all of the
  1  8 following are complied with:
  1  9    Sec. 2.  Section 99B.10, Code 2003, is amended by adding
  1 10 the following new subsection:
  1 11    NEW SUBSECTION.  4.  Each electrical and mechanical
  1 12 amusement device in operation or distributed in this state is
  1 13 licensed by the department as provided by this subsection.
  1 14 Each person engaging in business as a distributor of
  1 15 electrical and mechanical amusement devices in this state
  1 16 shall obtain a license tag for each electrical and mechanical
  1 17 amusement device distributed.  Upon receipt of an application
  1 18 and a fee of twenty-five dollars for each device, the
  1 19 department shall issue a biennial license tag which tag shall
  1 20 be displayed as required by rules adopted by the department.
  1 21 The application shall be submitted on forms designated by the
  1 22 department and contain the information required by rule of the
  1 23 department.  A license may be renewed biennially upon payment
  1 24 of the biennial license fee and compliance with this chapter
  1 25 and the rules adopted pursuant to this chapter.
  1 26    Sec. 3.  NEW SECTION.  99B.10A  MANUFACTURERS AND
  1 27 DISTRIBUTORS OF ELECTRICAL AND MECHANICAL AMUSEMENT DEVICES –
  1 28 LICENSE.
  1 29    A person shall not engage in business as a manufacturer or
  1 30 a distributor of electrical and mechanical amusement devices
  1 31 in this state without first obtaining a license from the
  1 32 department.  Upon receipt of an application and a fee of two
  1 33 thousand dollars for a manufacturer's license or a fee of one
  1 34 thousand dollars for a distributor's license, the department
  1 35 shall issue an annual license.  The application shall be
  2  1 submitted on forms designated by the department and contain
  2  2 the information required by rule of the department.  A license
  2  3 may be renewed annually upon payment of the annual license fee
  2  4 and compliance with this chapter and the rules adopted
  2  5 pursuant to this chapter.
  2  6    Sec. 4.  NEW SECTION.  99B.12A  BINGO EXCEPTION.
  2  7    An organization that is exempt from federal income taxes
  2  8 under section 501(c)(3), 501(c)(4), 501(c)(5), 501(c)(6),
  2  9 501(c)(7), 501(c)(8), 501(c)(10), or 501(c)(19) of the
  2 10 Internal Revenue Code as defined in section 422.3, shall be
  2 11 authorized to conduct a bingo occasion without a license as
  2 12 otherwise required by this chapter if all of the following
  2 13 requirements are met:
  2 14    1.  Participants in the bingo occasion are not charged to
  2 15 enter the premises where bingo is conducted.
  2 16    2.  Participants in the bingo occasion are not charged to
  2 17 play.
  2 18    3.  Any prize awarded at the bingo occasion shall be
  2 19 donated to the organization.
  2 20    4.  The bingo occasion is conducted as an activity and not
  2 21 for fundraising purposes.  
  2 22                           EXPLANATION
  2 23    This bill amends provisions in Code chapter 99B governing
  2 24 games of skill and chance.
  2 25    Code section 99B.10, governing electrical and mechanical
  2 26 amusement devices, is amended to provide that the devices are
  2 27 required to be licensed.  The Code section is amended to
  2 28 provide for a $25 biennial license tag for each device, which
  2 29 tag shall be displayed on each device in use.  New Code
  2 30 section 99B.10A is created to provide that a person shall not
  2 31 engage in business as a distributor or manufacturer of
  2 32 electrical and mechanical amusement devices without a license.
  2 33 The new Code section provides for a $2,000 manufacturer's
  2 34 license and a $1,000 distributor's license, which shall be
  2 35 issued on an annual basis.
  3  1    New Code section 99B.12A provides an exception to the
  3  2 licensing requirements for a nonprofit organization conducting
  3  3 a bingo game if the participants in the game are not charged
  3  4 to enter the premises where the game is played and are not
  3  5 charged to play the game, any prize awarded is donated to the
  3  6 organization, and the bingo game is conducted as an activity
  3  7 and not a fundraiser.
