1 1 Section 1. Section 455B.183, subsection 1, Code 2003, is
1 2 amended to read as follows:
1 3 1. The construction, installation, or modification of any
1 4 disposal system or public water supply system or part thereof
1 5 or any extension or addition thereto except those sewer
1 6 extensions and water supply distribution system extensions
1 7 that are subject to review and approval by a city or county
1 8 public works department pursuant to this section, the use or
1 9 disposal of sewage sludge, and private sewage disposal
1 10 systems. Unless federal law or regulation requires the review
1 11 and approval of plans and specifications, a permit shall be
1 12 issued for the construction, installation, or modification of
1 13 a public water supply system or part of a system if a
1 14 qualified, registered engineer certifies to the department
1 15 that the plans for the system or part of the system meet the
1 16 requirements of state and federal law or regulations. The
1 17 permit shall state that approval is based only upon the
1 18 engineer's certification that the system's design meets the
1 19 requirements of all applicable state and federal laws and
1 20 regulations and the review of the department shall be
1 21 advisory. A permit for the construction of a new disposal
1 22 system shall not be issued unless the requirements of section
1 23 455B.183D have been met.
1 24 Sec. 2. NEW SECTION. 455B.183D DISPOSAL SYSTEM
1 25 CONSTRUCTION REQUIREMENTS.
1 26 1. A disposal system constructed after the effective date
1 27 of this Act shall meet the construction design standards for
1 28 formed and unformed manure storage structures provided in
1 29 sections 459.307 and 459.308 and all distance requirements
1 30 provided in section 459.310. The department shall require a
1 31 construction design statement to be a part of the construction
1 32 permit application process. The construction design statement
1 33 shall be similar to the construction design statement used
1 34 pursuant to section 459.306.
1 35 2. For all disposal systems constructed prior to the
2 1 effective date of this Act, a renewal of an operational permit
2 2 for a disposal system shall not be issued unless a plan for
2 3 the construction of berms has been approved by the department.
2 4 EXPLANATION
2 5 This bill relates to construction requirements for disposal
2 6 systems. A disposal system is a system for disposing of
2 7 sewage, industrial waste, or other wastes.
2 8 The bill requires a disposal system constructed after the
2 9 effective date of the bill to meet construction design
2 10 standards required for formed and unformed manure storage
2 11 structures and all distance requirements for manure storage
2 12 structures. The bill requires a construction design statement
2 13 to be a part of the construction permit application process.
2 14 The bill requires that for all disposal systems constructed
2 15 prior to the effective date of the bill, a renewal of an
2 16 operational permit for a disposal system shall not be issued
2 17 unless a plan for the construction of berms has been approved
2 18 by the department of natural resources.
