1 1 Section 1. Section 272.2, subsection 2, Code 2003, is
1 2 amended to read as follows:
1 3 2. Establish, collect, and refund fees for a license. All
1 4 fees collected shall be deposited in the revolving fund
1 5 created pursuant to section 272.10, subsection 2.
1 6 Sec. 2. Section 272.10, unnumbered paragraph 1, Code 2003,
1 7 is amended to read as follows:
1 8 1. It is the intent of the general assembly that licensing
1 9 fees established by the board of educational examiners be
1 10 reasonable and sufficient to finance the activities of the
1 11 board under this chapter. The executive director shall
1 12 account for and manage any funds received by the board to
1 13 defray the expenses of the board.
1 14 Sec. 3. Section 272.10, unnumbered paragraph 2, Code 2003,
1 15 is amended by striking the unnumbered paragraph and inserting
1 16 in lieu thereof the following:
1 17 2. A revolving fund is created in the state treasury to be
1 18 administered by the board of educational examiners. The
1 19 revolving fund shall consist of moneys collected by the board
1 20 as licensing fees, moneys appropriated by the general
1 21 assembly, and any other moneys obtained or accepted by the
1 22 board for deposit in the revolving fund. The proceeds of the
1 23 revolving fund are appropriated to and shall be used by the
1 24 board to administer this chapter. The board shall submit an
1 25 annual report not later than January 31 to the department of
1 26 management, the members of the general assembly, and the
1 27 legislative fiscal bureau, of the fees received and deposited
1 28 in the fund by the board, categorized by the type of fee, and
1 29 of the activities funded by and expenditures made from the
1 30 revolving fund during the preceding fiscal year. Section 8.33
1 31 does not apply to any moneys in the revolving fund and,
1 32 notwithstanding section 12C.7, subsection 2, earnings or
1 33 interest on moneys deposited in the revolving fund shall be
1 34 credited to the revolving fund.
1 35 Sec. 4. Section 272.11, Code 2003, is repealed.
2 1 EXPLANATION
2 2 This bill creates a revolving fund in the state treasury to
2 3 be administered by the board of educational examiners. The
2 4 bill appropriates the moneys in the revolving fund, which
2 5 consists of all moneys collected by the board from licensing
2 6 fees and any other moneys received by the board. The bill
2 7 authorizes the board to use the moneys to administer the
2 8 provisions of Code chapter 272, which establishes the board
2 9 and provides practitioner licensure and certification
2 10 requirements.
2 11 The bill also requires the board to submit an annual report
2 12 by January 31 to the department of management, the general
2 13 assembly, and the legislative fiscal bureau, of the fees
2 14 deposited and the activities funded by and expenditures made
2 15 from the revolving fund during the preceding fiscal year.
2 16 Under the bill, revolving fund moneys do not revert to the
2 17 general fund and earnings and interest on the moneys deposited
2 18 in the fund are credited to the fund.
2 19 The bill requires the executive director of the board to
2 20 account for and manage any funds received by the board to
2 21 defray the expenses of the board.
2 22 The bill repeals Code section 272.11, which requires that
2 23 the expenditures and refunds made by the board be certified to
2 24 the director of revenue and finance by the board's executive
2 25 director, and requires the director of revenue and finance,
2 26 upon the director's approval of the expenditures and refunds,
2 27 to draw warrants upon the treasurer of state from the funds
2 28 appropriated by the general assembly for purposes of the
2 29 board.
