1 4 RELATING TO THE USE OF TITLES PERTAINING TO PHYSICAL THERAPY
1 5 AND PROVIDING A PENALTY.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. NEW SECTION. 148A.7 FALSE USE OF TITLES
1 10 PROHIBITED.
1 11 A person or business entity, including the employees,
1 12 agents, or representatives of the business entity, shall not
1 13 use in connection with that person's or business entity's
1 14 business activity the words "physical therapy", "physical
1 15 therapist", "licensed physical therapist", "registered
1 16 physical therapist", "doctor of physical therapy", "physical
1 17 therapist assistant", "licensed physical therapist assistant",
1 18 "registered physical therapist assistant", or the letters
1 19 "P.T.", "L.P.T.", "R.P.T.", "D.P.T.", "P.T.A.", "L.P.T.A.",
1 20 "R.P.T.A.", or any other words, abbreviations, or insignia
1 21 indicating or implying that physical therapy is provided or
1 22 supplied, unless such services are provided by or under the
1 23 direction and supervision of a physical therapist licensed
1 24 pursuant to this chapter. Notwithstanding section 147.74, a
1 25 person or the owner, officer, or agent of an entity that
1 26 violates this section is guilty of a serious misdemeanor, and
1 27 a license to practice shall be revoked or suspended pursuant
1 28 to section 147.55. This section shall not apply to the use of
1 29 the term "physiotherapy" by a provider licensed under this
1 30 chapter, chapter 151, or by an individual under the direction
1 31 and supervision of a provider licensed under this chapter or
1 32 chapter 151.
1 33 Sec. 2. Section 148A.6, subsection 1, Code 2003, is
1 34 amended by striking the subsection.
