  1  4 EXPANDING THE CIRCUMSTANCES BY WHICH THE JUVENILE COURT MAY
  1  5    MODIFY, VACATE AND SUBSTITUTE, OR TERMINATE A CHILD IN NEED
  1  6    OF ASSISTANCE DISPOSITIONAL ORDER.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 232.103, subsection 3, Code Supplement
  1 11 2003, is amended to read as follows:
  1 12    3.  A change in the level of care for a child who is
  1 13 subject to a dispositional order for out-of-home placement
  1 14 requires modification of the dispositional order.  A hearing
  1 15 shall be held on a motion to terminate or modify a
  1 16 dispositional order except that a hearing on a motion to
  1 17 terminate or modify an order may be waived upon agreement by
  1 18 all parties.  Reasonable notice of the hearing shall be given
  1 19 to the parties.  The hearing shall be conducted in accordance
  1 20 with the provisions of section 232.50.
  1 21    Sec. 2.  Section 232.103, subsection 4, Code Supplement
  1 22 2003, is amended to read as follows:
  1 23    4.  The court may modify a dispositional order, vacate and
  1 24 substitute a dispositional order, or terminate an a
  1 25 dispositional order and release the child if the court finds
  1 26 that the any of the following circumstances exist:
  1 27    a.  The purposes of the order have been accomplished and
  1 28 the child is no longer in need of supervision, care, or
  1 29 treatment.
  1 30    b.  The purposes of the order cannot reasonably be
  1 31 accomplished.
  1 32    c.  The efforts made to effect the purposes of the order
  1 33 have been unsuccessful and other options to effect the
  1 34 purposes of the order are not available.
  1 35    d.  The purposes of the order have been sufficiently
  2  1 accomplished and the continuation of supervision, care, or
  2  2 treatment is unjustified or unwarranted.
