  1  1    Section 1.  Section 481A.57, Code 2003, is amended to read
  1  2 as follows:
  1  3    481A.57  POSSESSION AND STORAGE.
  1  4    1.  A person having lawful possession of game or fur-
  1  5 bearing animals or their pelts, except deer venison, may hold
  1  6 them for not to exceed thirty days after the close of the open
  1  7 season for such game or furbearers.  A person having lawful
  1  8 possession of deer venison which is taken with a valid deer
  1  9 hunting license, may hold the deer venison from the date of
  1 10 taking until the following September 1.  From September 1
  1 11 until the first day of the next deer open season for which the
  1 12 person holds a valid deer hunting license, the person shall
  1 13 not possess more than twenty-five pounds of deer venison.  Any
  1 14 person may possess up to twenty-five pounds of deer venison if
  1 15 the deer was obtained from a lawful source.  A permit to hold
  1 16 for a longer period may be granted by the department.
  1 17    2.  Notwithstanding subsection 1, a person may lawfully
  1 18 possess deer venison in any amount, if the person receives the
  1 19 deer venison as a gift and receives a gift receipt from a
  1 20 person who obtained lawful possession of the deer venison by
  1 21 taking a deer with a valid deer hunting license, and may hold
  1 22 the deer venison from the date of receipt until the following
  1 23 September 1.  From September 1 until the first day of the next
  1 24 deer open season that corresponds to the season in which the
  1 25 deer was taken, the person shall not possess more than twenty-
  1 26 five pounds of the deer venison so received.  A permit to hold
  1 27 deer venison received as a gift for a longer period may be
  1 28 granted by the department.  The commission shall adopt rules
  1 29 setting forth what information shall be included in the gift
  1 30 receipt, including but not limited to the information
  1 31 contained on the deer tag that was used when the deer was
  1 32 taken.
  1 33    Sec. 2.  Section 483A.8, Code Supplement 2003, is amended
  1 34 by adding the following new subsection:
  1 35    NEW SUBSECTION.  7.  The commission shall provide by rule
  2  1 for the issuance of a senior antlerless deer hunting license
  2  2 that is valid only during the period beginning on January 1
  2  3 and ending at sunset on January 31 to a person who is a
  2  4 resident and who is sixty-five years of age or older.  The fee
  2  5 for the permit shall be ten dollars.  A resident hunting deer
  2  6 with a license issued under this subsection shall be otherwise
  2  7 qualified to hunt deer in this state and shall have a resident
  2  8 hunting license and pay the wildlife habitat fee.  
  2  9                           EXPLANATION
  2 10    This bill amends Code section 481A.57 to provide that a
  2 11 person may lawfully possess deer venison in any amount, if the
  2 12 person receives the deer venison as a gift and receives a gift
  2 13 receipt from the person who obtained lawful possession of the
  2 14 deer venison by taking a deer with a valid hunting license,
  2 15 and may hold the deer venison from the date of receipt of the
  2 16 gift until the following September 1.  From September 1 until
  2 17 the first day of the next deer open season that corresponds to
  2 18 the season in which the deer was taken, the person shall not
  2 19 possess more than 25 pounds of the deer venison so received.
  2 20 The bill also provides that a permit to hold venison received
  2 21 as a gift for a longer period may be granted by the
  2 22 department.  The commission is directed to adopt rules setting
  2 23 forth what information shall be included in the gift receipt,
  2 24 including but not limited to the information contained on the
  2 25 deer tag that was used when the deer was taken.  A violation
  2 26 of this provision is punishable by a scheduled fine of $100
  2 27 pursuant to Code section 805.8B, subsection 3, paragraph "e".
  2 28    The bill also directs the natural resource commission to
  2 29 provide by rule for the issuance of a senior antlerless deer
  2 30 hunting license to residents who are 65 years of age or older
  2 31 that is valid only during the month of January and costs $10.
  2 32 A resident hunting deer with such a license is required to be
  2 33 otherwise qualified to hunt deer in this state and to have a
  2 34 resident hunting license and pay the wildlife habitat fee.  A
  2 35 violation of this provision is punishable by a scheduled fine
  3  1 of $25 pursuant to Code section 805.8B, subsection 3,
  3  2 paragraph "c".
