  1  1    Section 1.  Section 300.4, Code 2003, is amended to read as
  1  2 follows:
  1  3    300.4  COMMUNITY EDUCATION AND PUBLIC EVENTS.
  1  4    The tax levied under sections 300.2 and 300.3 may also be
  1  5 used for community education purposes under chapter 276. the
  1  6 following additional purposes:
  1  7    1.  Community education purposes under chapter 276.
  1  8    2.  The purchase of athletic uniforms, equipment, and
  1  9 supplies, and for other non-infrastructure-related purposes
  1 10 involving the maintenance of athletic training programs and
  1 11 participation in athletic competitions, contests, or events
  1 12 that are open to the public.
  1 13    3.  The purchase of equipment, materials, and inventory
  1 14 utilized in the study and public presentation of the
  1 15 performing and fine arts, including dance, music, theater, and
  1 16 visual arts.
  1 17    Sec. 2.  APPLICABILITY.  This Act is applicable to levies
  1 18 imposed by voter approval on or after the effective date of
  1 19 this Act.  This Act shall also be applicable to the
  1 20 permissible uses for local option sales tax for school
  1 21 infrastructure revenue pursuant to section 422E.1, subsection
  1 22 3.  
  1 23                           EXPLANATION
  1 24    This bill provides for additional authorized uses of
  1 25 revenue derived by a school district from imposition of the
  1 26 educational and recreational tax levy.  The bill provides that
  1 27 revenue may be utilized for the purchase of athletic uniforms,
  1 28 equipment, and supplies, and for other non-infrastructure-
  1 29 related purposes involving the maintenance of athletic
  1 30 training programs and participation in athletic competitions,
  1 31 contests, or events open to the public.  The bill also
  1 32 provides that revenue may be utilized for the purchase of
  1 33 equipment, materials, and inventory utilized in the study and
  1 34 public presentation of the performing and fine arts, including
  1 35 dance, music, theater, and visual arts.  The bill applies to
  2  1 tax levies approved by the voters on or after the effective
  2  2 date of the bill, and is applicable to the permissible uses
  2  3 for local option sales tax for school infrastructure revenue
  2  4 pursuant to section 422E.1, subsection 3.
  2  5    The bill provides that the additional uses shall be
  2  6 authorized for levies imposed on or after the bill's effective
  2  7 date.
