  1  1    Section 1.  Section 514I.2, subsection 6, Code Supplement
  1  2 2003, is amended to read as follows:
  1  3    6.  "Eligible child" means an individual who meets the
  1  4 definition of "child" under 42 C.F.R. } 457.10 and the
  1  5 criteria for participation in the program under section
  1  6 514I.8.
  1  7    Sec. 2.  Section 514I.5, subsection 8, paragraph e, Code
  1  8 Supplement 2003, is amended by adding the following new
  1  9 subparagraph:
  1 10    NEW SUBPARAGRAPH.  (15)  Prenatal and delivery services.
  1 11    Sec. 3.  AMENDMENT OF STATE PLAN – STATE CHILDREN'S HEALTH
  1 12 INSURANCE PROGRAM.  The department of human services shall
  1 13 submit an amendment to the state children's health insurance
  1 14 program state plan to the centers for Medicare and Medicaid of
  1 15 the United States department of health and human services to
  1 16 allow the state program to incorporate the provisions of 42
  1 17 C.F.R. } 457.10.
  1 18    Sec. 4.  EFFECTIVE DATES.
  1 19    1.  The sections of this Act amending sections 514I.2 and
  1 20 514I.5 take effect upon receipt of approval by the department
  1 21 of human services from the centers for Medicare and Medicaid
  1 22 of the United States department of health and human services
  1 23 of the state plan amendment to the state children's health
  1 24 insurance program as described in section 3 of this Act.  Upon
  1 25 receipt of the approval, the director of human services shall
  1 26 inform the Iowa Code editor of the date that approval was
  1 27 received.
  1 28    2.  The section of this Act requiring the department of
  1 29 human services to submit an amendment to the state children's
  1 30 health insurance program state plan, being deemed of immediate
  1 31 importance, takes effect upon enactment.  
  1 32                           EXPLANATION
  1 33    This bill relates to eligibility of children under the
  1 34 healthy and well kids in Iowa (hawk-i) program.  The bill
  1 35 changes the definition of "eligible child" to include an
  2  1 individual who meets the definition of "child" under a federal
  2  2 regulation.  Under that regulation, 42 C.F.R. } 457.10,
  2  3 "child" means an individual under the age of 19 including the
  2  4 period from conception to birth.  The bill also changes the
  2  5 benefits to be provided under the hawk-i program to include
  2  6 prenatal and delivery services.
  2  7    The bill directs the department of human services to submit
  2  8 a state children's health insurance program (SCHIP) state plan
  2  9 amendment to the centers for Medicare and Medicaid services of
  2 10 the United States department of health and human services to
  2 11 allow the state program to incorporate the provision of the
  2 12 federal regulation.
  2 13    The sections of the bill that amend the definition of
  2 14 "eligible child" and add prenatal and delivery services to the
  2 15 benefits package take effect upon receipt of approval of the
  2 16 state plan amendment.  The section of the bill directing the
  2 17 department of human services to submit the state plan
  2 18 amendment takes effect upon enactment.
