PAG LIN 1 1 Section 1. Section 481A.38, subsection 1, unnumbered 1 2 paragraph 2, Code 2003, is amended to read as follows: 1 3 a. The commission shall adopt a rule permitting a crossbow 1 4 to be usedonlyby individuals with disabilities who are 1 5 physically incapable of using a bow and arrow under the 1 6 conditions in which a bow and arrow is permitted. The 1 7 commission shall prepare an application to be used by an 1 8 individual requesting the status. The application shall 1 9 require the individual's physician to sign a statement 1 10 declaring that the individual is not physically able to use a 1 11 bow and arrow. 1 12 b. The commission shall adopt a rule permitting a crossbow 1 13 to be used for taking deer, under the conditions in which a 1 14 bow and arrow is permitted, by any deer hunting licensee who 1 15 is sixty-five years of age or older. The commission shall 1 16 prepare an application to be used by an individual requesting 1 17 permission to use a crossbow to hunt deer during bow hunting 1 18 season. The application shall require the applicant to 1 19 produce proof of the applicant's age. 1 20 EXPLANATION 1 21 This bill directs the natural resource commission to adopt 1 22 a rule permitting a deer hunting licensee who is 65 years of 1 23 age or older to use a crossbow under the conditions under 1 24 which a bow and arrow is permitted to be used. The bill also 1 25 provides that the commission shall prepare an application to 1 26 be used by persons requesting permission to use a crossbow to 1 27 hunt deer and require the applicant to produce proof of the 1 28 applicant's age. 1 29 A violation of the provisions of the bill is punishable by 1 30 a scheduled fine of $100 or $50 under Code section 805.8B, 1 31 subsection 3, paragraph "f" or "g". 1 32 LSB 5433HH 80 1 33 av/sh/8
