  1  1    Section 1.  STUDENT ACHIEVEMENT AND TEACHER QUALITY
  1  2 PROGRAM.  There is appropriated from the general fund of the
  1  3 state to the department of education for the fiscal year
  1  4 beginning July 1, 2004, and ending June 30, 2005, the
  1  5 following amount, or so much thereof as is necessary, to be
  1  6 used for the purposes designated:
  1  7    For purposes of the student achievement and teacher quality
  1  8 program established pursuant to chapter 284:  
  1  9 .................................................. $123,306,336
  1 10    a.  Of the amount appropriated in this section, $20,000,000
  1 11 shall be allocated to school districts on a per pupil basis
  1 12 calculated with the weighted enrollment determined in
  1 13 accordance with section 257.6, subsection 5, for purposes of
  1 14 adding the equivalent of two additional contract days as
  1 15 provided in section 284.4, subsection 1, paragraph "c".
  1 16    b.  Of the amount appropriated in this section, $2,140,000
  1 17 shall be allocated to area education agencies, based upon each
  1 18 area education agency's percentage of the total full-time
  1 19 equivalent elementary and secondary teachers employed in the
  1 20 school districts in this state, for purposes of providing
  1 21 career development programs that meet the requirements
  1 22 specified in section 284.6, subsection 1.
  1 23    Sec. 2.  Section 256.21, unnumbered paragraph 4, Code 2003,
  1 24 is amended to read as follows:
  1 25    A sabbatical grant to a teacher shall be equal to the costs
  1 26 to the school district of the teacher's regular compensation
  1 27 as defined in section 294A.2 plus the cost to the district of
  1 28 the fringe benefits of the teacher.  The grant shall be paid
  1 29 to the school district, and the district shall continue to pay
  1 30 the teacher's regular compensation as well as the cost to the
  1 31 district of the substitute teacher.  Teachers and boards of
  1 32 school districts are encouraged to seek funding from other
  1 33 sources to pay the costs of sabbaticals for teachers.  Grant
  1 34 moneys are miscellaneous income for purposes of chapter 257.
  1 35    Sec. 3.  Section 284.4, subsection 1, paragraph c, Code
  2  1 Supplement 2003, is amended to read as follows:
  2  2    c.  Provide, beginning in the fifth fourth year of
  2  3 participation, the equivalent of two additional contract days,
  2  4 outside of instruction time, than were provided in the school
  2  5 year preceding the first year of participation, to provide
  2  6 additional time for teacher career development that aligns
  2  7 with student learning and teacher development needs, including
  2  8 the integration of technology into curriculum development, in
  2  9 order to achieve attendance center and district-wide student
  2 10 achievement goals outlined in the district comprehensive
  2 11 school improvement plan.  School districts are encouraged to
  2 12 develop strategies for restructuring the school calendar to
  2 13 provide for the most effective professional development,
  2 14 evaluate their current career development alignment with their
  2 15 student achievement goals and research-based instructional
  2 16 strategies, and implement district career development plans.
  2 17 A school district that provides the equivalent of ten or more
  2 18 contract days for career development is exempt from this
  2 19 paragraph.
  2 20    Sec. 4.  Section 284.13, subsection 1, paragraphs b through
  2 21 e, Code Supplement 2003, are amended to read as follows:
  2 22    b.  For the fiscal year beginning July 1, 2003 2004, and
  2 23 ending June 30, 2004 2005, to the department of education, the
  2 24 amount of seven hundred thousand two million dollars for the
  2 25 issuance of national board certification awards in accordance
  2 26 with section 256.44.
  2 27    c.  For the fiscal year beginning July 1, 2003 2004, and
  2 28 succeeding fiscal years, an amount up to four million two
  2 29 hundred thousand dollars for first-year and second-year
  2 30 beginning teachers, to the department of education for
  2 31 distribution to school districts for purposes of the beginning
  2 32 teacher mentoring and induction programs.  A school district
  2 33 shall receive one thousand three hundred dollars per beginning
  2 34 teacher participating in the program.  If the funds
  2 35 appropriated for the program are insufficient to pay mentors
  3  1 and school districts as provided in this paragraph, the
  3  2 department shall prorate the amount distributed to school
  3  3 districts based upon the amount appropriated.  Moneys received
  3  4 by a school district pursuant to this paragraph shall be
  3  5 expended to provide each mentor with an award of five hundred
  3  6 dollars per semester, at a minimum, for participation in the
  3  7 school district's beginning teacher mentoring and induction
  3  8 program; to implement the plan; and to pay any applicable
  3  9 costs of the employer's share of contributions to federal
  3 10 social security and the Iowa public employees' retirement
  3 11 system or a pension and annuity retirement system established
  3 12 under chapter 294, for such amounts paid by the district.
  3 13    d.  For the fiscal year beginning July 1, 2003 2004, and
  3 14 ending June 30, 2004 2005, up to one million three hundred
  3 15 twenty-five thousand dollars to the department of education
  3 16 for purposes of establishing the evaluator training program,
  3 17 including but not limited to an evaluation process; the
  3 18 training of providers; development of a provider approval
  3 19 process; training materials and costs; for payment to
  3 20 practitioners under section 284.10, subsection 3, and to pay
  3 21 any applicable costs of the employer's share of contributions
  3 22 to federal social security and the Iowa public employees'
  3 23 retirement system or a pension and annuity retirement system
  3 24 established under chapter 294, for such amounts paid by the
  3 25 district; and for subsidies to school districts for training
  3 26 costs.  A portion of the funds allocated to the department for
  3 27 purposes of this paragraph may be used by the department for
  3 28 administrative purposes.
  3 29    e.  For the fiscal year beginning July 1, 2003 2004, and
  3 30 ending June 30, 2004 2005, up to three seven hundred seventy-
  3 31 five thousand dollars to the department of education for
  3 32 purposes of implementing the career development program
  3 33 requirements of section 284.6, and the review panel
  3 34 requirements of section 284.9.  From the moneys allocated to
  3 35 the department pursuant to this paragraph, not less than
  4  1 seventy-five thousand dollars shall be used to administer the
  4  2 ambassador to education position in accordance with section
  4  3 256.45.  A portion of the funds allocated to the department
  4  4 for purposes of this paragraph may be used by the department
  4  5 for administrative purposes.
  4  6    Sec. 5.  Section 284.13, subsection 1, Code Supplement
  4  7 2003, is amended by adding the following new paragraphs:
  4  8    NEW PARAGRAPH.  i.  For the fiscal year beginning July 1,
  4  9 2004, and each succeeding fiscal year, the amount of one
  4 10 hundred thousand dollars to the department of education for
  4 11 distribution to the tribal council of the Sac and Fox Indian
  4 12 settlement located on land held in trust by the secretary of
  4 13 the interior of the United States.  Moneys allocated under
  4 14 this paragraph shall be used for the purposes specified in
  4 15 section 256.30.
  4 16    NEW PARAGRAPH.  j.  For the fiscal year beginning July 1,
  4 17 2004, and each succeeding fiscal year, the amount of one
  4 18 hundred seventy thousand dollars to the state board of regents
  4 19 for distribution in the amount of sixty-eight thousand dollars
  4 20 to the Iowa braille and sight saving school and in the amount
  4 21 of one hundred two thousand dollars to the Iowa state school
  4 22 for the deaf for minimum salary supplements based upon the
  4 23 average student yearly enrollment at each institution as
  4 24 determined by the state board of regents.
  4 25    NEW PARAGRAPH.  k.  For the fiscal year beginning July 1,
  4 26 2004, and each succeeding fiscal year, the amount of ninety-
  4 27 four thousand six hundred dollars to be paid to the state
  4 28 board of regents for distribution to licensed classroom
  4 29 teachers at the Iowa braille and sight saving school and the
  4 30 Iowa school for the deaf for payments of minimum salary
  4 31 supplements based upon the average yearly enrollment at each
  4 32 school as determined by the state board of regents.
  4 33    NEW PARAGRAPH.  l.  For the fiscal year beginning July 1,
  4 34 2004, and each succeeding fiscal year, the amount of one
  4 35 hundred fifteen thousand five hundred dollars to be paid to
  5  1 the department of human services for distribution to its
  5  2 licensed classroom teachers at institutions under the control
  5  3 of the department of human services for minimum salary
  5  4 supplements based upon the average student yearly enrollment
  5  5 at each institution as determined by the department of human
  5  6 services.
  5  7    NEW PARAGRAPH.  m.  For the fiscal year beginning July 1,
  5  8 2004, and each succeeding fiscal year, the amount of two
  5  9 hundred thirty thousand dollars for a kindergarten to grade
  5 10 twelve management information system.
  5 11    Sec. 6.  Chapter 294A, Code 2003 and Code Supplement 2003,
  5 12 is repealed.  
  5 13                           EXPLANATION
  5 14    This bill repeals Code chapter 294A, which creates the
  5 15 educational excellence program and includes a standing
  5 16 appropriation for the program.  The bill appropriates $123.3
  5 17 million for FY 2004-2005 to the department of education from
  5 18 the state general fund for purposes of the student achievement
  5 19 and teacher quality program established under Code chapter
  5 20 284.  The bill directs that funding provided for the student
  5 21 achievement and teacher quality program be used to provide for
  5 22 some of the purposes and entities currently provided for under
  5 23 Code chapter 294A.
  5 24    Of the moneys appropriated under the bill, approximately
  5 25 $101.1 million is designated for purposes of the student
  5 26 achievement and teacher quality program, which includes
  5 27 funding for the teacher career path, the beginning teacher
  5 28 mentoring and induction program, national board certification,
  5 29 evaluator training, and career development.  The bill also
  5 30 transfers allocation language from Code chapter 294A to Code
  5 31 chapter 284 to continue to provide funds to the department of
  5 32 education for a K-12 management information system, and to
  5 33 provide for salary increases for licensed classroom teachers
  5 34 at department of human services institutions, the Iowa braille
  5 35 and sight saving school, the Iowa school for the deaf, and the
  6  1 Sac and Fox Indian settlement; and professional development at
  6  2 the Iowa braille and sight saving school and the Iowa state
  6  3 school for the deaf.
  6  4    The bill allocates $20 million to school districts for use
  6  5 in adding two additional contract days into school district
  6  6 calendars.  The bill restores an earlier, and since modified,
  6  7 requirement that school districts provide the additional
  6  8 contract days beginning in their fourth year of participation
  6  9 in the student achievement and teacher quality program.  For
  6 10 most Iowa school districts, this fourth year of participation
  6 11 is the 2004-2005 school year.
  6 12    The bill also allocates $2.14 million to area education
  6 13 agencies to provide career development programs for Iowa
  6 14 teachers.
  6 15    The educational excellence program repealed by the bill
  6 16 consists of three phases:  Phase I establishes a minimum
  6 17 annual salary and a formula for distribution of state moneys
  6 18 to assist school districts in meeting the minimum salary
  6 19 requirement; phase II provides state aid for general salary
  6 20 increases; and phase III moneys are distributed to assist in
  6 21 the development of performance-based pay plans and
  6 22 supplemental pay plans requiring additional instructional work
  6 23 assignments.  The bill strikes any Code references to Code
  6 24 chapter 294A.
